Trump sued over '1-in-2-out' regulations order
Source: The Hill
Liberal groups are challenging President Trumps order requiring federal agencies to repeal two regulations for every new rule they issue.
The National Resources Defense Council (NRDC), Communications Workers of America, and Public Citizens sued Trump on Wednesday in the United States District Court for the District of Columbia to block the so-called 1-in-2-out executive order.
The left-leading groups argue Trumps Jan. 30 order exceeds his authority under the Constitution and will block important health, safety and environmental protections without taking the benefits of those rules into account.
Chris Shelton, president of the Communications Workers of America, said workers shouldnt be required to trade off one set of job, health and safety protections in order to get protection from another equally dangerous condition.

(17,387 posts)Lets just ignore a Congressional Law governing how regulations are adopted, and impose some arbitrary standard that directly conflicts with it.

(3,847 posts)bullshit "executive orders."
Agencies are now so short staffed as the appointees are puging their depts., they are following the
Dear Leaders" example and trying to wreck this country as quickly as they can.

(7,309 posts)... at least going back 40 years or so. Until now, they at least paid lip-service to it, and tried to restrain themselves as much as possible, so as to not attract attention to their agenda. Now, they don't even care about appearances; they will push their agenda through until there is nothing left of our system of governance. They won't stop until we are a feudal society - which is their endgame. Also, until now, the Democrats have gone along to get along, which was the exact wrong approach to take. Now, some liberal groups are "shocked" and now filing appeals to courts that have mostly been filled by the reactionaries. Some courts still care about the democratic process, but many are filled with Trumpists, who would like nothing better than to see us revert back to feudalism.
This is exactly what the Bolsheviks did. They slowly filled the soviets (workers' councils) with members of their party, slowly filled all agencies and congresses and the like. Lenin, who was as anti-Soviet as it gets - he believed in one party rule, his party, of course), yelled "All power to the soviets!" during the revolution - hoping to gain favor with the workers' parties. Once he was closer to ruling, he shutdown any soviets that didn't bend to the Bolshevik program (see Petrograd Soviet and the Kronsdat Rebellion). Once, enough power was concentrated, the already poisoned revolution was dead. And the society that the Bolsheviks desired was achieved, which benefited the party, not the people.
Same thing is happening now. History repeats itself.

(4,991 posts)like this are obsolete regulations that no one ever gets rid of but because they still exist they can (and are enforced) or are used as precedent for another action.
Just as one example:
In 1949 regulations were implemented to form (and I kid you not) the "National Raisin Reserve" (under the control of the Dept of Agriculture) in order to regulate post WWII raisin prices.
The "raisin reserve" was not alone, versions also existed for almonds, walnuts, tart cherries as well as other products. All but the the raisin reserve were disbanded over the years but the raisin reserve stood alone...defiant...and proud.
It finally took a case argued in front of and ruling by the Supreme Court (8-1 decision) to eliminate a regulation that had long outlived its usefulness.
Is it that wrong to have these agencies to go thru their regulations and get rid of ones that are obsolete?

(4,395 posts)Just do an audit and get rid of regulations that are obsolete.
Don't bog down new, necessary, regulations with some arbitrary requirement that other regulations have to be removed before you can enact new ones.
It's difficult enough to get new regulations through Congress without adding an additional step of trying to dig out some other random, unrelated regulations you can get rid of, and increase the scope of the matters than can be debated by tagging them on to whatever you are trying to accomplish.
What this will actually accomplish is to slow down or kill any new regulation, some of which is vitally necessary (e.g. FDA regulations).
