TROY, N.Y. (AP) The "partisan hostility" surrounding the confirmation of Justice Neil Gorsuch is of concern because it could undermine public confidence in the apolitical nature of the judicial system, U.S. Supreme Court Chief Justice John Roberts said Tuesday at a college appearance in upstate New York.
The appearance a day after Gorsuch was sworn in by President Donald Trump at the White House was billed as a conversation with Rensselaer Polytechnic Institute President Shirley Ann Jackson. Jackson talked with Roberts onstage before about 1,200 students, faculty and guests, some of whom asked him questions.
"The Supreme Court currently does operate in a highly political environment, one that some feel has come about because of the refusal of the U.S. Senate to consider Judge Merrick Garland, President Barack Obama's nominee for the seat that opened up after the death of Justice Antonin Scalia," Jackson said.
After most Democrats refused to support Gorsuch, Republicans resorted to using the "nuclear option" to eliminate the 60-vote filibuster threshold for Gorsuch and all future high court nominees. But Roberts said the political turmoil didn't carry over to the court's work.

(33,345 posts)Right. Just "some", having "feelings" about Obama being denied a nomination through naked partisanship. Some being anyone who paid attention to the entire debacle and isn't a Republic.

(11,330 posts)He didn't say anything about the refusal to consider Obama's nominee. so Roberts essentially confirmed that the Supreme Court is political.

* Stolen nomination.
** Couldn't be confirmed without "nuclear" option rules change to override filibuster.

(10,011 posts)Roberts has supported the notion that corporations have the rights of people, to the detriment of actual people. The conservative wing of the Supreme Court truly matches the Republican Party with their rulings that favor corporations over the rights of people. And now we have another originalist who can sway the Court with Republican theories devised from thin air. Roberts should have objected publicly and vehemently last year at the Republicans' refusal even to show Merrick Garland, a well-respected judge, the courtesy of a hearing. I hope Gorsuch will forever be identified as the only Supreme Court justice to occupy a stolen seat.

(4,490 posts)The GOP stonewalled a qualified center right leaning judicial pick and instead changed Senate rules to install a perjurer nominated by an illegitimate president. That's about as hostile as partisan politics get, taking the idea to a whole new level.
