Marine accused of trespassing during rally to be discharged

BURLINGTON, N.C. (AP) — One of two U.S. Marines charged with trespassing during a rally at a Confederate monument in North Carolina is being discharged from the Corps.

The Times-News of Burlington reports public information officer Capt. Joshua Pena said Camp Lejeune-based Staff Sgt. Joseph W. Manning is being processed for discharge based on his arrest on May 20.

Manning and 35-year-old Marine Sgt. Michael Joseph Chesny, who is stationed at Marine Corps Air Station Cherry Point, were arrested in Graham. Police say they climbed on top of a building prior to a Confederate Memorial Day rally and unfurled a banner which read, in part, "YWNRU," which stands for "You will not replace us," the slogan chanted by demonstrators in Charlottesville, Virginia, protesting the removal of a Confederate monument.
 
Chesny's status isn't known.

Manning was arrested with Michael Joseph Chesny, 35, of Havelock during a the rally in Graham’s Court Square. Police say they climbed on top of 101 N. Main St., a building adjacent to the historic courthouse, prior to Alamance County Taking Back Alamance County’s Confederate Memorial Day rally, without permission of the owner, Jason Cox.

They face misdemeanor charges, which the military does not like, but they are probably in more trouble because while they were on that roof, they let down a banner that read, “He who controls the past controls the future,” a quote from George Orwell’s novel “1984,” and the banned also featured an “Identitarian” symbol and the letters “YWNRU” on the side — “You will not replace us,” the slogan chanted by demonstrators carrying torches in Charlottesville, Va., at protests of the removal of a Confederate monument in May and at the infamous “Unite the Right” protest Aug. 11 and 12. According to a protest leader, the slogan is an affirmation of being white.

2. No, most likely general discharge. Dishonorable discharge requires a Court-Martial conviction

Here is the hierarchy of discharges from best to worst

- honorable discharge

- general discharge under honorable conditions

- other than honorable (OTH) discharge

- bad conduct discharge (issued by special court martial or general court martial)

- dishonorable discharge

There is also entry-level separation.

All discharges below honorable other than the dishonorable discharge are typically upgraded to honorable discharge after a certain amount of time.

A dishonorable discharge is only given after a General Court-Martial. There are three levels of Court Martial and General is the most serious. In order of seriousness of offense and potential consequences, the Court Martial levels are

- Summary Court Martial

- Special Court Martial

and

- General Court Martial

not typically upgraded. According to Yale, the Army tends to approve ~40% of upgrade requests while the Coast Guard tends to approve ~1% with the Navy and Marine Corps falling in the lower middle. A successful appeal might be upgrading a Bad Conduct Discharge (BCD) to an Other Than Honorable (OTH) or an OTH to General Under Honorable. In addition, for all avenues of requesting a discharge upgrade, a statute of limitations exists. Also, the applicant must show to the Discharge Review Board or the Board for Correction of Military Records the discharge characterization was improper or inequitable.

I frequently work with Veterans that were told at their discharge they will be able to get their OTH/BCD discharge upgraded after six months. Nothing is farther from the truth.

Looks like they give incorrect information on this in all the services for some reason. Perhaps they don't want to scare the troops?

They really ought to tell people. I mean, they scare you enough with the descriptions of military justice so that new enlistees know the military is not the place for monkey business, but if they understood how permanent their discharge is likely to be, that might provide additional incentive not to engage in bad behavior. I'm glad that isnt something I need to worry about. Got my honorable discharge right from the get go.

they are perpetuating a myth and should have certainly known better. The discharge upgrade BS has persisted as long as I can recall (at least throughout my service from 87-09 and probably decades longer) and it persists today among Veterans of all ages, ranks, and services. I commonly am asked about upgrades in my effort to assist Veterans in finding employment, training, benefits, and education.
