Pennsylvania will fight the Commerce Department's decision to add a citizenship question to the 2020 Census, Attorney General Josh Shapiro said Wednesday.
The inclusion of the citizenship question in this rushed manner and at this late stage is unlawful. It is arbitrary and capricious and violates the Trump Administration's constitutional obligation to ensure the accuracy of the 2020 census, he said. I plan to take legal action to ensure an accurate count of all Pennsylvania residents and fair distribution of federal funding.
California has already sued to block the administration from adding the question to the 2020 Census, arguing that the question will discourage non-citizens from answering the Census. The would keep the decennial census from meeting its constitutional mandate of accurately counting the country's entire population, the lawsuit says.
The suit also claims that Commerce Secretary Wilbur Ross ignored procedures and arbitrarily added the query to the proposed list of questions he's submitting to Congress for approval. Noting that six former Census directors, from both Republican and Democratic administrations, have opposed restoring the question, which was removed in 1950, Shapiro said the rushed decision to add the question could hurt Pennsylvania.
