One-person grand jury named in Michigan fake candidate scandal

LANSING — Ingham County Circuit Judge Rosemarie Aquilina has been named to conduct a one-person grand jury investigation into whether House Speaker Jase Bolger or state Rep. Roy Schmidt committed crimes in connection with their recruitment of a fake state House candidate in Grand Rapids, a court official said today.

Rhonda Swayze, deputy administrator of the general trial division of Ingham County Circuit Court, said an order appointing the grand jury was signed Monday by Chief Circuit Judge Janelle Lawless.

All nine Ingham judges were to vote on appointing a grand jury after Michigan Democratic Party Chairman Mark Brewer and Senate Minority Leader Gretchen Whitmer, D-East Lansing, requested the investigation last week. Aquilina was chosen by blind draw.

Schmidt, R-Grand Rapids, amid extensive consultation with Bolger, R-Marshall, recruited a fake Democratic candidate to face Schmidt as Schmidt jumped from the Democratic to the Republican party on May 15, just ahead of that day’s filing deadline for the Aug. 7 primary.

6. It's a grand jury in name only

The judge can't issue indictments and only investigates and presents a report of the investigation. If they wanted to indict anyone they would have to convene a full grand jury of 16-23 people per Michigan law.

8. Thanks for the clarification Major. Poorly written article IMO.

The DFP should have made this clarification in the article. Perhaps Michigan law allows for this process to be called a "grand jury", but clearly it's not.
