President Donald Trump dared former CIA director John Brennan to sue him over the revocation of his classified clearance.
The president ramped up his feud Monday morning with the former intelligence official after announcing last week that Brennan no longer had access to classified information.

Brennan said the day before that he may pursue legal action against the president, who revoked his security clearance last month and announced the move last week.
Trump admitted he revoked Brennans clearance as punishment for his criticism, and dozens of former top intelligence officials signed on to a letter blasting the move.

(1,990 posts)It would simply be a suit to get a court to rule that the President doesn't have that power. Trump's pretending the issue is "cause", when its not. The issue is whether the EO he points to or Article II actually grant the President the unfettered power to revoke security clearances. Brennan's job performance is not the issue, because it it were, they would have just gone through the proper procedure which would have publicly demonstrated why Brennan shouldn't have the clearance. But there was no "cause" to revoke his clearance, so they didn't go through the correct process.
The sad part is, his sponsoring agency - I assume the CIA - could have issued a statement saying something to the affect that "there is an established procedure for revoking security clearances which includes due process, and this is not it. Until that process has been completed, we will treat Director Brennan as the respected member of the intelligence community that he is". But that would have taken nuts by someone to stand up to Trump and let the cards fall where they fall.

(6,881 posts)He's always threatening to sue people he wants to get back at. And when the courts go against him, he pretty much concedes. As with his Muslim immigration ban and child separation. We'll see what he says about Manafort, if it's not hung. As Pres. Exec. he has ways around the courts , like slow walking the child separation order, and there's always the pardon. It seems he's desperately looking for some kind of "official" validation, that he has not been able to get from the "establishment". Even DOJ is his enemy. A loser trying to win prestige.

Roberts is usually also a fierce rw partisan, but occasionally shows some care for the constitution, which none of the other 4 ever do. He votes with the hardened rw'ers 90% of the time so can't really put much faith in him either.
