Trump Plans To File Appeal In Emoluments Case

President Trump is appealing a lower court’s decision not to throw out one of the emoluments cases against him, according to a Friday court filing.
In the document filed in federal court in Maryland, Trump gave notice that he intends to appeal the decision to the U.S. Court of Appeals for the Fourth Circuit. Trump made the filing in his individual capacity, and was not represented by government attorneys, but instead by attorney William Consovoy.
The appeal is coming in a case filed by the attorneys general for Maryland and DC, who allege that Trump is violating the constitution by accepting foreign gifts in the form of visits from foreign officials to his hotels.
DOJ attorneys acting for Trump in his official capacity had argued on Nov. 30 that Judge Peter Messitte should delay discovery in the case until the appeal was concluded. Messitte denied that request, and discovery began two weeks ago.
