House Votes to Block Trump's Border Emergency Declaration

WASHINGTON -- The House voted on Tuesday to overturn President Trump's declaration of a national emergency on the Mexican border, with more than a dozen Republicans joining Democrats to try to block his effort to divert funding to a border wall without congressional approval.

The resolution of disapproval, which passed 245-182, must now be taken up by the Senate, where three Republicans have already declared their support, only one short of the number needed for Congress to ratify a stinging rebuke of Mr. Trump's efforts.

It remains highly unlikely that opponents will muster the votes to overturn a promised veto of the resolution. But passage of a measure to assert Congress's constitutional authority over spending is sure to bolster numerous lawsuits that maintain that Mr. Trump's declaration is an unconstitutional end run around Congress's lawful power of the purse.

"Is your oath of office to Donald Trump or is it to the Constitution of the United States?" Speaker Nancy Pelosi asked her Republican colleagues in a speech on the floor ahead of the vote. "You cannot let him undermine your pledge to the Constitution."

Looking at that vote count, there are 8 votes missing (1 I know one missing is that NC GOPer due to the fraudulent election in a district). This should have been unanimous among Democrats but apparently it wasn't (or there were people not voting/not there).

that requires a vote within 18 days of receipt. I.e., it's not standard "legislation" in and of itself but is a provision in the Act that authorized the President to declare an "emergency", where Congress is authorized to call for a vote to repeal any "emergency" declaration. However the resolution is still subject to the veto.

In addition to the ninth district fiasco, Rep Walter Jones died a few weeks ago. The special election to replace him will likely be concurrent with the ninth district do over.

so it's not entirely in vain. The arguments in the lawsuits center around whether the declaration is even valid since what is being called a "national emergency" really isn't one and then there is the issue of reprogramming money that had already been designated by Congress for specific things (not "wall" ). A judge could technically put a halt to the whole thing until the cases work their way through the courts.

But they would still need 2/3rds in each chamber to override a veto for this particular resolution, so with 3 vacancies in the House, that would theoretically be 288 (if all others who didn't vote, voted) and 67 in the Senate.

President to declare something an emergency to do an end run around Congress and we should accept it as a gift.
After all the next Democrat could use it to do a number of things like for example a National Supreme Court Emergency and enlarge the court and add 6 spots.
Followed up by a National Healthcare Emergency and declare medicare for everyone followed by a National Violent Gun Deaths emergency and so on and so on.
So really we should thank the Repugnants because they will be the ones that made it possible by giving the President the consent to do whatever he wants like a King.
