Supreme Court sides with Colorado church challenging COVID rules

Washington — The Supreme Court on Tuesday sided with a Colorado church challenging the state's capacity restrictions on houses of worship during the coronavirus pandemic, the latest order from the high court, now with a 6-3 conservative majority, in favor of churches and synagogues seeking to hold worship services during the ongoing crisis.

In an order with three dissents, the high court tossed out an August decision from the federal district court in Colorado that kept the attendance limits in place and sent the dispute back to the lower courts for further consideration in light of its November order barring New York from enforcing capacity restrictions at houses of worship.

In that case, the Supreme Court ruled 5-4 in favor of churches and synagogues that argued New York Governor Andrew Cuomo's limitations on attendance at religious institutions in coronavirus hotspots were unconstitutional.

Justice Elena Kagan, joined by Justices Sonia Sotomayor and Stephen Breyer dissented in the Colorado case, writing it is moot because Colorado lifted the attendance limits in response to the Supreme Court's ruling in the challenge to New York's coronavirus restrictions.

I can't see where the court would have a leg to stand on if/when it gets an assisted suicide case. Because that's what this decision is, the right to commit suicide by covid.

If they want handle snakes, forego medical care for viruses, medical precautions, or medical care in its entirety then let them.

Maybe their numbers will dwindle until only the sharper christians remain.

Seems reasonable. Not too many were allowed inside.
But for the churches who really want to cram together, no one is forcing them to go. And it IS their right.

I am a church member, which I know disturbs some DUers. I have not been inside a church since March. During the spring shutdown, my church offered parking lot services, with people remaining in their cars. When they reopened in the fall, it was with very strict rules, set by the church, on capacity, distancing, mask wearing, temp checks, and no singing.

But cases are rising alarmingly in this region, so the church governing body ruled two weeks ago to shut down completely and go totally virtual until mid January. No Christmas services.

The right to freedom of religion does not mean the right to put the community at risk. On the contrary, religious groups have an obligation, if they live up to their teachings, to look after the well being of their members and of others.

Unfortunately, they’ll get Covid and then spread it throughout their communities. If governments are not allowed to prevent public gatherings for churches, then how can they prevent any public gathering because any organization or group can claim discrimination because churches are allowed to operate. Does this decision give churches special dispensation over all other organizations or does it just say government has no right to protect the public? The SC has forgotten that the Constitution gives us freedom from religion. That freedom should include the freedom to avoid the deliberate spread of a killer virus in our communities.

As such, High Plains already has the relief it seeks," they said.

Our insane, corrupt Supreme Court is speeding the downfall of the nation.

Someone should hold a secualr congregation right next door to the church. If they are arrested, they should sue for violation of Equal Protection. I wonder what our wise Supreme Court would say about that.

The Court has to be very careful about the rulings they make because they become precedent that can and will be used down the road. Because of this, the court can't always focus on the current environment but the issue itself.

It's always been about protection of corporations, white male property owners, millionaires and billionaires, and the Retrumplican donor class.

These rulings are a shiny object to fake Christians so they don't see their labor protections, pensions and social safety net being destroyed.

It's a perfect con, because by the time they realize they've been screwed, they'll just shrug and say their "austerity" is just "God's Will".

Makes me hope that there really is a god, because if there is, he's busy throwing these asspickles into a lake of fire.
