Trump impeachment trial will start week of Feb. 8, Schumer says

Source: Washington Post

Majority Leader Charles E. Schumer (D-N.Y.) announced on Friday that the Senate impeachment trial of Trump will begin the week of Feb. 8. House Speaker Nancy Pelosi (D-Calif.) plans to send the article of impeachment to the Senate on Monday. Trump faces a charge of “incitement of insurrection” for his role in instigating the deadly mob attack on the Capitol Jan. 6.

Senate Minority Leader Mitch McConnell (R-Ky.) had proposed delaying the start of the trial into mid-February, allowing Trump time to recruit a defense team and assemble arguments against conviction. President Biden on Friday signaled that he supported a delay, saying, “the more time we have to get up and running to meet these crises, the better.”

Some rank-and-file Democrats also expressed alarm at putting Biden’s agenda on hold to conduct a trial of Trump. “I want to focus as much attention right now on the Biden agenda as possible, and minimize the attention on anything other than the Biden agenda,” said Sen. Tim Kaine (D-Va.). Kaine is part of a small group of Democrats pushing an idea of passing a resolution stating that Trump violated the 14th Amendment — which forbids federal officials from ever holding office if they “engaged in insurrection or rebellion” against the government — and ban him from running again for president in that manner.

Negotiations over the trial’s length and format are expected to continue through the weekend, according to Senate aides, who spoke on the condition of anonymity to describe internal discussions.

The House is STILL sending it over on Monday.

apparently each party has a "Leader Suite" that is pretty luxurious (plus each has their own "working office" outside of the Capitol), so I expect they will keep their suites and just get new name plates.

Here was something that Turtle did for CSPAN back in 2016 in his suite -

Here's an article on Schumer's Leader Suite (with pics) - https://www.syracuse.com/politics/2017/09/sen_chuck_schumers_position_earns_him_elegant_second_office_photos.html

The House on the other hand, apparently does do a swap.

Republicans don't convict him, but 14 only takes a simple majority. You put up whatever barriers you can, and if it comes to that, let them sue and let the SCOTUS decide a very unambiguous 14th Amendment.

he wants to ditch Trump like a used condom.
The reason for the delay though is because Mitch is probably planning something like having 8 of the Senate Republicans join the Democrats to impeach and he will have enough of the ones that are going to run in 2022 and 2024 "boycott" the the trial in order to meet the requirement of 2/3 of the those present to vote to convict.

McConnell seems to want him "gone"... but he essentially is. Few (if any) republicans want to damage their support by hitting him when he's already out of office - especially when it's too easy to say "I would consider conviction but I don't think the Constitution contemplates impeachment for officials who are already gone".

... or that making him ineligible is the right way to do it.

On a side note - I also doubt that Trump would have any interest at all in anything lower than President.

Congress is not involved at all in 14 unless they're voting to "remove such disability"

The only way for 14 to take effect is for him to be convicted of insurrection in court.

10. Senate ends standoff, agrees to start Trump's impeachment trial Feb. 9
Fri Jan 22, 2021, 10:02 PM
Jan 2021

The impeachment trial of former president Donald Trump will begin Feb. 9 under a deal reached Friday by top Senate leaders — delaying by two weeks the high-stakes proceedings over whether Trump incited the violent Jan. 6 attack on the U.S. Capitol.

The agreement was made by Senate Majority Leader Charles E. Schumer (D-N.Y.) and Minority Leader Mitch McConnell (R-Ky.) following a standoff over the timing of the trial, which could permanently bar Trump from holding public office.

The House on Jan. 13 passed a sole impeachment article, alleging “incitement of insurrection.” House leaders could have forced the Senate to begin the trial immediately by transmitting the papers across the Capitol. But a delay serves the former and current presidents: Trump has struggled to assemble a legal team and muster a defense, and President Biden needs the Senate to confirm most of his Cabinet appointees.

McConnell pushed Thursday for a three-week delay, but Schumer and House Speaker Nancy Pelosi (D-Calif.) on Friday morning announced their intention to deliver the impeachment papers Monday — setting up a trial as soon as Tuesday. Later in the day, Biden publicly called for a delay, saying, “the more time we have to get up and running to meet these crises, the better.”
