Constitutional ban on legal pot advances in Idaho
Source: ABC News
As legal weed becomes a reality in every corner of the U.S., Idaho is putting up a fight.
State lawmakers on Friday moved forward with a proposed constitutional amendment that would bar the legalization of marijuana in Idaho in an attempt to keep the growing nationwide acceptance of the drug from seeping across its borders.
Idaho is one of only three states without some sort of policy allowing residents to possess products with even low amounts of THC, the psychoactive chemical in marijuana. Residents can cross the state border in nearly every direction and find themselves in a place where marijuana can be bought for recreational or medicinal purposes. Support for medicinal marijuana use is growing among some residents with legalization activists trying to get an initiative on the state ballot in 2022.
It's made some lawmakers in the deep-red state nervous, particularly after voters in the neighboring state of Oregon decriminalized the personal possession of drugs like heroin, cocaine and methamphetamine last November.

(63 posts)Local laws can still ban sales. There are dry counties when it comes to alcohol. Same can apply to weed. It can be banned on a local level. If that level is an entire state, so be it. That is up the people of Idaho. Just another reason not to go to Idaho.

(60,320 posts)It's not their constitutionality. They can make state laws and local laws.
The point is that their Constitutional Amendment will be as pointless as the Prohibition's two Constitutional Amendments.
Same will happen to theirs if it is ever adopted.

(13,582 posts)Our constitution has not been amended as long as Ive been here. Lets hope this dumb ass bill along with the legislatures desire to strip emergency declarations away form the governor are both non-starters.
FWIW - this is all coming from southern Idaho and its anti-masker Mormon potato farmer legislators.

(4,919 posts)Due to COVID, I wonder if they will re-think this little move.
We have been having a tough time getting to Legalized Recreational Marijuana in NYS.
But, since the economy has been hurting in NY due to COVID, now Cuomo is saying legalization needs to pass this year (or so I read somewhere a short while ago).
Makes sense since the revenue from sales will be a huge boost to the state.

(22,196 posts)just about 10 feet past the state line on every highway, road, route, dirt road, mountain goat trail, hiking path, and rabbit run there will be a shiny dispensary with flashing neon arrows and a well lit parking lot within the next year.
If you want practically a sure money bet, invest in LED and neon sign companies, and paving tar companies in the area.
Like better investments than the stock market!!!!

(8,509 posts)any state agency from predicting tides that were higher than historical references. We said it was denying nature and gravity to do so. They said it is OUR Legislature and we'll do as we please. We said it won't be the Rapture that swamps expensive sea-side properties, it will be hurricanes and rising tides in general, much as the record suggests. They said "You're making it up and have no proof."
The clowns in Idaho don't believe science is true. They think it is an elitist opinion. They are so stupid about some of this that it's a wonder they make it across the street in light traffic as they head for the local bar... And some of them really do think God is Their Witness, as if GOD were only available for Idaho GOP functions.
