Biden says he supports return to 'talking filibuster'

President Biden said for the first time Tuesday that he supports changing the Senate filibuster rules to bring back the so-called “talking filibuster,” a notable shift after the White House insisted that his preference was to not make changes.

Biden during an interview with ABC News anchor George Stephanopoulos said he endorses reforming the filibuster by returning to the tradition of talking filibusters — when senators need to be on the floor talking to block bills — because “democracy is having a hard time functioning.”

“You had to stand up and command the floor and you had to keep talking along,” Biden said. “Once you stopped talking, you lost that and someone could move in and say, I move to the question of.”

“You’ve got to work for the filibuster,” Biden said. “It is almost getting to the point where democracy is having a hard time functioning.”

I expect all fifty will be on board once the crunch comes.

McConnell and his crew really have made action to throttle them down essential to governing the country.

The sort of critter who gets elected Senator now really hasn't the stomach for the old school filibuster.

On June 25, 2013, Davis held a thirteen-hour-long filibuster to block Senate Bill 5, a measure which included more restrictive abortion regulations for Texas.

The GOP are wimps and could not possibly do what she did. 13 hours. No bathroom. No break. Nothing. The GOP can't make it 13 minutes.

Actually having to hold the floor ties up all Senate business, nothing else can be done till the speechifying ceases or is voted down.

Mere notice of withholding unanimous consent on a matter allows other business to be conducted.

The understanding was that the 'silent filibuster' would be seldom used, and for a good while that is how the matter stood. It stood because people in both parties were interested in governing, and so were interested in reaching compromise solutions. Measures about which the minority party could say, well, that's something I can live with, even if I don't like it much.

Now, one party is interested only in obstruction, and so the common understanding necessarily falls apart. It is worth noting that most uses of the filibuster in the earlier style were in regard to things that a faction (not necessarily a party) did consider absolutely had to be halted, and if they could not be defeated, had to be obstructed as long as possible. But these were episodes, not a consistent policy to see that the majority was balked from doing anything.
