(CNN) -- former Louisville, Kentucky, police officer has pleaded guilty to hitting a kneeling person in the head who was surrendering during an arrest in May last year, according to a statement from the Department of Justice.
Cory Evans, 33, appeared in court and pleaded guilty Wednesday in the incident, which happened while he was an officer with the Louisville Metro Police Department on duty during protests following the police killings of Breonna Taylor and George Floyd.
On May 31, 2020, Evans was on patrol for violations of curfew and unlawful assembly, according to the DOJ statement.
As one man surrendered for arrest by getting on his knees and placing his hands in the air, Evans "struck the victim in the back of the head with a riot stick," according to the statement. The victim, who suffered a head wound, then fell forward and was taken into custody by other officers.

A man who says Louisville Metro Police abused him during a controversial traffic stop in 2018 lunged at an officer before being taken to the ground, police body camera footage shows.
Cellphone video originally shared on social media showed Jarrus Ransom being pulled down and punched five times by Officer Cory Evans. That video, recorded by a bystander, was shot from far away and was grainy.
The body cam video of the Dec. 10, 2018, arrest was obtained by The Courier Journal in a Jan. 2 open records request following the police department's exoneration of Evans.
In a letter to Evans in early December 2019, Chief Steve Conrad exonerated him of the charges of being discourteous and using excessive force. He will face no disciplinary action, Conrad said.

LMPD plans to fire officer accused of hitting kneeling protester in the head in May 2020
Jun 10, 2021 Updated Jun 10, 2021
LOUISVILLE, Ky. (WDRB) -- The Louisville Metro Police Department plans to fire an an officer who is being federally charged for hitting a kneeling protester in the back of the head with a riot stick during a demonstration for racial justice on May 31, 2020.
LMPD Officer Cory Evans, who is scheduled to plead guilty in court next month, was served pre-termination paperwork Thursday, the department announced in a statement.
The department released a statement Thursday evening saying the Chief's Office "immediately referred" the allegations against Evans to federal authorities "when they came to light."
"Internal investigations were stayed in deference of the federal investigations, and Officer Evans was placed on administrative reassignment," the statement continued. "The federal investigations resulted in Evans' indictment yesterday (June 9). Officer Cory Evans was served with pre-termination paperwork today (June 10)."
Evans is scheduled for a change of plea hearing on July 14, which indicates he will plead guilty on a charge of injuring a protester who was allegedly "kneeling with hands in the air, surrendering for arrest" when he hit them in the back of the head with a riot stick, according to court records.
