House Speaker Nancy Pelosi on Friday rebuked the Supreme Court for ending a nationwide eviction ban, which puts millions of vulnerable renters at risk of eviction as new COVID-19 infections sweep the United States.
"Eviction is a horror that no family should ever have to experience - with cribs and personal belongings on the street, children in fear and distress and parents struggling to find basic shelter," Pelosi said in a statement. "Putting people out of their homes and forcing them to crowd in with others is also a public health risk as the delta variant accelerates."
The Supreme Court on Thursday evening struck down the Biden administration's 60-day extension of the eviction moratorium, which was announced on August 3.
In a 6-3 decision, the court ruled that the Centers for Disease Control and Prevention, which issued the moratorium, had no legal authority to do so. The conservative majority argued that it's up to Congress to "specifically authorize" a "federally imposed eviction moratorium." The three liberal justices dissented, arguing that Congress has allocated billions in federal aid to help landlords cover rent, and that an eviction ban isn't as extreme as government-imposed coronavirus lockdown restrictions.

Speaker Pelosi is looking for ways to speed aid to renters. I'm not about to bet against her finding a way or making one.

(2,022 posts)There are a lot of Dems who don't want to touch this - the support for the moratorium at this time and with this economy is mixed at best. So Pelosi doesn't want to deal with it either, yet criticizes the supreme court - taking the low road of politics.

(17,193 posts)In principle, should the Executive or the Legislative branch be responsible for addressing this problem? Setting aside the other question, which is whether it should be a Federal or State regulation in the first place. Is it really the province of the USSC to rule on this, when it is not a Constitutional issue?
The next question is whether the CDC should have or does have the legal authority to issue a moratorium on rents. Looked at objectively, I can see no reason why they should. It is not exactly a health issue. Masks, social distancing, other clearly health-related issues, yeah, I suppose they could have the legal power to issue such orders (even though they are unelected officials). But if they can restrict evictions, why not, say, automobile repossessions or bill collections? Are they concerned with finance or health?
The argument in favor amounts to "Something must be done to help these poor people." Of course, there is no gainsaying that. What a shame that our country's government -- particularly its legislature, but the USSC is guilty, too -- is so badly broken that it has to resort to extralegal methods to provide that help.

You are exactly right. And it should be frightening to us all that the CDC tried to overreach its authority like this.

(33,327 posts)the Administration had to find a way to keep people in their homes, even temporarily. This was the work-around because the US Senate is broken.
I'm not particularly frightened about this. I'm not sure where the slippery slope would lead.
