Temporary Restraining Order Issued Against NYC Vaccine-Or-Test Requirement For City Employees

The New York State Supreme Court has issued a temporary restraining order against New York City's vaccine requirements for municipal workers. The order means the city cannot enforce its COVID-19 vaccine mandates, pending a hearing on September 22nd.

Judge Laurence Love signed the order after the Municipal Labor Committee and other unions brought a lawsuit against the city, the Department of Health and Mental Hygiene and the city's Board of Education.

In late July, Mayor Bill de Blasio called for all city workers to get vaccinated or tested weekly. All public school staff must be vaccinated but don't have the option to test out. Both rules set deadlines for employees to get their first doses of COVID-19 vaccines by September 27th.

1. Why are they not following the SCOTUS ruling Jacobson vs Massachusetts 1905...why?

Ruling clearly states the rights of the individual does not outweigh the rights of many when it comes to public health!!

Oh I hate these ppl that are refusing the vaccine..if they die so be it!

3. That ruling said the state could fine someone $5 for not getting vaccinated

It's perhaps debatable as to whether that ruling would logically extend to allowing the State to fire its workers (in this case, in contravention of Union Contracts) if they refuse to be vaccinated.

P.S. I also don't care if the stupid people catch C19 and die.

the right to be safe from plague rats spreading deisease trumps any court ruling.

ignore it. without teh executive branch to enfore any ruling the court ruling is just hot air

5. maybe new york state court needs some stacking too?

If we can't get a mandate passed in NYC...that just...I can't even....

And what the hell is going on with the unions? We need to send over some DNC and CDC employees to educate these people and get them back on track.

7. We have a similar situation

here in Philly with respect to unions opposing vaccination mandates - particularly one local of UNITE HERE (Local 634 for the Cafeteria Workers and School Aides in the school system), many who belong to the very demographics most impacted by covid infections and death.

One of the main complaints that unions like this and USPS are promoting is that these mandates are "a change in working conditions" and they want to be able to bargain/negotiate it as a change in their contract. Other city worker unions had welcomed the mandates and sold it to their members.

So what the city was able to do was negotiate the change into the Cafeteria workers contract so that they won't be "fired" if they aren't vaccinated but will have to mask and submit to 2X a week testing. They were currently testing once a week as part of the initial masking mandate to open schools in-person. This was announced here yesterday (thus no lawsuit, etc).

This is not a ruling on the case, it just said "hold off one week until I hear the case."
