Virginia attorney general moves to withdraw from ERA lawsuit

RICHMOND, Va. (AP) Republican Virginia Attorney General Jason Miyares moved Friday to withdraw the state from a lawsuit that seeks to force the federal government to recognize Virginia's 2020 vote to ratify the Equal Rights Amendment and add the text to the Constitution.
In a court filing, Miyares asked that the commonwealth be dismissed as a party to the lawsuit, which was initiated by his Democratic predecessor and is currently on appeal before the U.S. Court of Appeals for the District of Columbia Circuit.
Miyares, who took office Jan. 15, has reconsidered Virginia's position and believes a district court previously correctly dismissed the suit, the filing said.
Former Attorney General Mark Herring and two other Democratic attorneys general initially brought the lawsuit in January 2020, days after Virginias legislature voted to make the Commonwealth the critical 38th state to ratify the amendment. The vote came after years of efforts by advocates who argued the amendment would guarantee women equal rights under the law. Miyares, then a member of the House of Delegates, voted against ratification.

My daughter lives in Virginia and she knew a number of people who werent going to vote because of that. No clue if they ended up voting anyway. But I bet not wanting to vote for someone who you dont think is good. But, thats a luxury we dont have right now.

(2,355 posts)Of around 48%, in addition to those who ignore the off-year elections? He beat Cuccinelli in 2013 with 47.8% (vs Cuccinelli's 45.2%), but there was a third party candidate who siphoned votes from Cuccinelli (and garnered 6.5%).
There was no third party candidate sucking votes from Youngkin, and McAuliffe's percentage was practically the same this time as it was in 2013. It's like not many people were excited by him, and a lot just voted for him holding their noses in both elections, while would-be Democratic voters weren't excited by the bland, white guy (who was also tarred as/by being close to the Clintons) and stayed home in droves (at least this time, as the turnout was down from prior years, IIRC).
I'm not from VA, but I pay attention to what goes on to my neighbor in the north. 😉

(22,802 posts)Never underestimate subliminal racial prejudices and Puritan sexual views among suburban voters. The bogus CRT fear mongering and sexual/gender book banning issues had a real effect on the election.

(860 posts)These are the areas Democratic Party members need to start targeting for progress. This is where gerrymandering happens and were voting rights are being restricted. This is where aborting gets restricted. I am pointing out only 2 areas being affected. There are many other ways the R's are overtaking the US and making it possible for an authoritarian take over the country.

(7,410 posts)Rescind or withdraw their votes now? I can't imagine that the states like TX, TN, IN, ND, SD, NE, ID, MT, WV, etc would all still support it's passage. They've probably never bothered since it's unlikely the current version will pass regardless, even RBG said a new version needed to be introduced because of all the legal problems with the current one.
