Prosecutors: Trump Mar-a-Lago security aide flipped after changing lawyers

A Trump employee who monitored security cameras at Donald Trump’s Mar-a-Lago estate abruptly retracted his earlier grand jury testimony and implicated Trump and others in obstruction of justice just after switching from an attorney paid for by a Trump political action committee to a lawyer from the federal defender’s office in Washington, prosecutors said in a court filing Tuesday.

The aide — described as “Trump Employee 4” in public court filings but identified elsewhere as Yuscil Taveras — held the title of director of information technology at Mar-a-Lago. He initially testified to a grand jury in Washington, D.C., that he was unaware of any effort to erase the videos, but after getting the new attorney “immediately … retracted his prior false testimony” and detailed the alleged effort to tamper with evidence related to the investigation of the handling of classified information stored at Trump’s Florida home, the new submission said.

Special counsel Jack Smith’s team revealed the details of the employee’s about-face as part of a filing demanded by Florida-based U.S. District Court Judge Aileen Cannon, who is overseeing the classified records case against the former president.

She had questioned why prosecutors continued to collect evidence from a grand jury empaneled in Washington, D.C., even after Smith obtained a grand jury indictment in Florida in June charging Trump with more than 30 counts of retaining classified documents at his Mar-a-Lago estate.

A key witness in the Mar-a-Lago classified documents case has retracted their "false testimony" after switching lawyers, special counsel Jack Smith's team contends in court filings obtained by Politico's Kyle Cheney. The witness is identified as "Employee 4" in Smith's legal team's notification to Judge Aileen Cannon.

"Chief Judge Boasberg made available independent counsel (the First Assistant in the Federal Public Defender's Office for the District of Columbia) to provide advice to Trump Employee 4 regarding potential conflicts. On July 5, 2023, Trump Employee informed Chief Judge Boasberg that he no longer wished to be represented by Mr. Woodward and that, going forward, he wished to be represented by the First Assistant Federal Defender."

The witness since retaining new counsel has provided evidence to prosecutors implicating Donald Trump along with his aide Walt Nauta and Mar-a-Lago staffer Carlos De Olivera, the filing contends.

"Immediately after receiving new counsel, Trump Employee 4 retracted his prior false testimony and provided information that implicated Nauta, De Oliveira and Trump in efforts to delete security camera footage, as set forth in the superseding indictment," the court filings said.

But Kyle Cheney might not have had chance to write it up yet. I'm not a fan of Politico either but do respect Kyle Cheney and the rest of the reporters who have been sitting at the courthouses and reporting (e.g., Scott McFarlane from CBS, etc).

The information came out originally, publically, in a Mara lago case filing.

You can read most of the case filings at court listener. Search by the case # and the whole docket comes up. This way, you get the whole story and that the media sensationalized version

He left Woodward because at his García hearing in DC he realized he was potentially going under the trump bus and was between a rock and a hard spot unless he told the truth.

Smith flipped him by having enough evidence that resulted in #4 either telling the truth or being indicted himself.

Actually I don't want anyone else hurt, just that one property which I realize is totally unrealistic, but to see it swept away to Atlantis or the Bermuda Triangle might make me believe in a higher power of some sort. Poseidon? Neptune? Karma, "God's will"? Something?

Someone wrote a comment online that is gold. I believe it was posted on the Lincoln Project page. It said something along the lines of, "Republicans use projection the way people with dysentery use toilet paper." I wish I could remember for sure, because I would tell whoever wrote that phrase to copyright it! Genius.

He is now between the guy below who has every reason to flip like the other guy and the Orange Ruski himself who Nauta surely must know will throw him to the wolves to protect himself. Wolf and Cuccinelli thought they had nothing to worry about. Remember that the supposed IG investigation claimed they couldn't be retrieved and were permanently gone. when the superseding indictment came out I thought we all guessed employee 4 was the good guy and was giving dirt on all of them, or at least on those who asked him to delete the video.

Not sure why this is breaking news? I know it was in Smith's pleadings in FL to show why the grand jury was still sitting and needed to take evidence but new? I'm confused.

He was given a target letter but wasn't charged at the time.

The fact that a filing was made TODAY as a result of Loose Cannon demanding it, and it is now "publicly admitted", is "breaking news". It continues to show why she needs to be removed.

ETA - Andrew Weissmann is literally on Alex Wagner's show right now saying the above about Cannon - (if she tries to preclude this then she WILL BE REVERSED).

Prosecutors from the special counsel’s office have focused their obstruction inquiries around Trump, Trump’s body man Walt Nauta and a maintenance worker who helped Nauta move boxes of classified documents ahead of federal agents searching the property last summer, and potentially others, sources told CNN.

The sources say that the maintenance worker is the person who drained the pool that led to the flooding of the IT room where the surveillance footage was held.

Last month, longtime Trump Organization executives Matthew Calamari Sr. and his son Matthew Calamari Jr., who each held senior roles overseeing security at Trump properties and the surveillance of the Florida club, appeared before the grand jury.

At the time, Investigators were interested in both the maintenance worker’s conversations and a text message from Nauta to Calamari Sr. where Nauta asked to talk. An attorney for Nauta declined to comment for this story. A spokesman for Trump and an attorney representing the maintenance worker did not immediately respond to a request to comment.

There is this mention of a "maintenance worker" and I don't know if Carlos De Oliveira, who worked with Nauta, and ended up being charged on a superseding indictment is that-then "maintenance worker" who had a phone seized, or whether there is someone else (other than this IT guy Taveras).

have short memories or do not actually read the filings. That is not the breaking news, it is more about why the GJ was still in session, the Judge had speculated that it might not be proper but DOJ confirms it was to deal with the perjury of the witness that flipped and it was the proper venue as that is the GJ he committed perjury to. It also is Smith schooling Cannon that she best not screw up the hearing for a conflict of interest because the other side is trying to say they can avoid conflict by not allowing the star witness testify instead of a hearing of conflict of the lawyer.

Sometimes it is like deja vu when people get excited about something that was previously reported and pretty certain from the filings.

time to think it through let alone read it. I think that many of them rely on the tv lawyers to explain things instead of reading the filings carefully themselves, except in the big indictments. I also think many of the tv lawyers themselves only read the bigger filings or else they cannot remember what was in previous filings.

with Cannon. They should have stopped to think "we already knew he was cooperating by the info in the previous filing which contained info that only employee 4 could have provided."

So I was confused. Glad to know it wasn't me but I do expect more from my new source.

for a Garcia hearing for Woodward's conflict of interests. Maybe it was not spelled out as clearly as today's filing but it was pretty clear. This is the wording in that motion from weeks ago.

"The Government has conferred with Trump Employee 4’s new counsel, and Trump Employee 4 does not intend to waive his rights to confidentiality, loyalty, and conflict-free representation with respect to his earlier representation by Mr. Woodward.

Trump Employee 4’s presence at the hearing is not required. As set forth above, Trump Employee 4 has informed the Government, through his new counsel, that he takes no position as to Mr. Woodward’s continuing representation of Nauta (or anyone else) but does not consent to the use or disclosure of his client confidences and expects Mr. Woodward to comport with the ethical rules regarding maintenance of client confidences."


I am at a loss why this is the big news, when it seems that really the news is that Smith is giving Cannon a first year law student lesson on how she may well get overturned again if she rules the wrong way and try to prevent the star witness from testifying (as Woodward suggests) instead of having a proper hearing on the conflicts of interests.

Weismann had touched on the "conflict of interest" thing, but that doesn't necessarily mean there would be a flip, although it does happen.

Taveras did receive a target letter but hadn't been charged (yet). So this latest, demanded by Loose Cannon, clarifies what was going on behind the scenes.

The fact that perjury was committed with Taveras' original testimony suggests a plea deal might have been in negotiation, assuming Smith was about to charge with another superseding indictment.

What this filing shows is that he had lied to the grand jury and when he got new counsel he changed his tune but we all knew that the charges against De Oliveira came from the "IT guy". The news in this filing is not about the flipping but about the idiot lawyer and his conflicts and the DOJ making it very clear to the judge she best not screw this up. It also confirms that the GJ in DC was still in session handling the perjury and the flipping of Taveras in answer to the Judges question about why there was still a GJ investigating in DC. It wasn't investigating but dealing with perjury from a previous witness and it was the proper place to hear his new testimony. That was new to us, as we all speculated why the GJ was still in session. The only thing not new to me was the guy got new representation and flipped, we knew that when they charged the superseding indictment.

it was all speculative and putting 2 + 2 together, but that doesn't = "a certainty". As it is, few knew that a grand jury had even been impaneled in FL as everything prior had been taking place in D.C. and then suddenly the buzz started (since the docs had been stored in FL) and witnesses started showing up at a courthouse in FL, and that is where the charges ended up being filed.

Some of us have even speculated that there might be one in NJ due to one of the most obvious potential "crimes" of "mishandling classified information", happened in Bedminster. But we haven't heard any confirmation of that...

Weissman. And the filing for the Garcia hearing confirmed it back in Aug 2 I think it was. Yes the GJ in session for his perjury is news as was the schooling of Cannon news but not that the IT guy flipped.

Go back and look at some of the discussions back when DeOliveira was indicted. This was such bs. And I included in my original post the wording in the filing of Aug 2 whereby Smith confirmed that the IT guy got new counsel. The only thing we didn't know is if he lied to the GJ and that was confirmed today. I think the tv commentors did not read the document before making their breaking news report. What she reported was hardly breaking news at all.

that described what was going on with the conflict of interest filings and the potential that 1 of the 3 (apparently Taveras) could testify against the other 2, with all having the same lawyer, and how that should be a no-go

But the OP report came from Politico that explicitly indicated there was a change of testimony noted in a filing that was done today and I think that confirmation was the big deal.

What Weissmann did note that I agree with, is that there may be other employees cooperating in addition... So we have to stay tuned!

There was nothing in that 8/2/23 court filing that explicitly indicated that there was "a flip". It was deduced that this is what might have happened, and articles were being written that this is probably what was going on, but it was not spelled out until 8/22/23.

This is the section in there that Weissmann brought up -

III. It Would Be Error to Suppress Trump Employee 4’s Testimony

Nauta contends (ECF No. 126 at 4-5) that if the Court finds a conflict, it should preclude
Trump Employee 4 from testifying at trial, rather than employ more routine remedies. That
proposed remedy is contrary to precedent and—except for the district court ruling reversed in
United States v. Messino, 181 F.3d 826 (7th Cir. 1999)—would appear to be unprecedented.
Courts have rejected exclusion of evidence as a remedy to avoid a conflict of interest,
concluding that evidence that is “relevant to the Government’s case” should not “be excluded to
accommodate a defendant’s choice of counsel.” United States v. Urbana, 770 F. Supp. 1552, 1559
n.17 (S.D. Fla. 1991); see Messino, 181 F.3d at 830; United States v. Lech, 895 F. Supp. 586, 592-
93 (S.D.N.Y. 1995). Exclusion of probative testimony “is an extreme sanction and would only
harm the interests of justice.” Lech, 895 F. Supp. at 592. A “defendant’s choice of counsel” should
not “take precedence over the Government’s discretion in deciding what charges to prosecute and
how to present its case.” United States v. Pungitore, 910 F.2d 1084, 1142-43 (3d Cir. 1990).

Nauta has not identified any case, and the Government is unaware of one, in which a
court has excluded evidence to avoid a conflict on facts remotely similar to this case, where the
Government put Mr. Woodward on notice long ago about potential conflicts, and he is now seeking
to affirmatively use those conflicts to gain a tactical advantage at trial by excluding highly
incriminating evidence to the benefit of not only his own client but also a co-defendant (Trump)
whose PAC is paying his legal fees. The Court should not countenance this maneuver.


What will need to be further clarified, which is now being speculated about in the media and by pundits, is whether there was a cooperation agreement that would waive a perjury charge in exchange for the testimony OR whether there might actually be a need for an agreement for a plea to perjury with cooperative testimony, in lieu of additional potential other charges related to obstruction.

When it comes to confirmations vs speculation or deductions or assumptions, I welcome the legal confirmation. The "legal confirmation" ( "admitting to" in a court filing) is "breaking". The reasons behind it are additional useful details of the background and outcome.

Some see talking heads speculating with authority, on the basis of their "former" statuses, and unfortunately that becomes "news."

I think that may explain frustrations with the pace of the investigations, thinking unconfirmed reporting is true.

This article makes Stanley out to be some superhero, helping the little guys - when really, he is up to his eyeballs with Trump. This Politico piece is a super slick marketing piece. Disgusting. This guy reps everyone from Oath Keepers to Navarro, Patel, Scavino, Nauta, Bannon etc.

Bizarre twist is Stanley's law partner is Tip O’Neill-era House counsel Stan Brand!

Will be interesting to see what Yuscil Taveras told Grand Jury about the advice Stanley gave him when preparing for his original testimony.

His first testimony was that he "didn't recall..." being asked to erase the videos?

As if that wasn't a huge red flag to begin with.
