Proud Boy Joe Biggs receives 17 years in Jan. 6 seditious conspiracy case

WASHINGTON Joe Biggs, a Proud Boys leader convicted of seditious conspiracy who the government says "served as an instigator and leader" during the Jan. 6 attack on the U.S. Capitol, was sentenced to 17 years in federal prison on Thursday.
It is among the longest sentences in Capitol riot cases. The record is the 18-year sentence given to Oath Keepers founder Stewart Rhodes, also convicted of seditious conspiracy, after prosecutors sought 25 years in federal prison in his case.
The government sought 33 years for Biggs, an Army veteran who sustained a head injury in Iraq and then served as a correspondent for the conspiracy website Infowars. Prosecutors argued that he was a vocal leader and influential proponent of the groups shift toward political violence and used his outsized public profile and his military experience as he led a revolt against the government in an effort to stop the peaceful transfer of power.
U.S. District Judge Timothy Kelly handed down Biggs' sentence. He ruled earlier in Thursday's hearing that Biggs tearing down of a fence that stood between police and rioters qualified him for a terrorism sentencing enhancement sought by prosecutors. Destroying the fence was a deliberate, meaningful step that contributed to the disruption of the electoral vote count occurring in the Capitol, Kelly said.

And, he should consider himself fortunate to get just those that 17 years, as the prosecution wanted over 30 years.

(112,818 posts)So many conflate probation ELIGIBILITY as the automatic "get-out-of-jail" card. It is not. Especially in the Federal system. Especially when police officers are injured or killed. Case in point, the sad episode of Leonard Pelletier, now on his 46th year incarcerated (in light of the intense lobbying of FBI against pardons by the past several Presidents and with a LOT of questions remaining about his guilt to begin with).
So, I don't worry too much about these actual guilty creeps getting out early.

I told my girlfriends father (maga) that it is unacceptable to talk about killing leaders of our Democracy, and that if we turn this country into a third world dictatorship, we will have nothing but violent, political overthrow, more often than not. That is why it is extremely important that we uphold our constitution.
With him, it went in one ear and out the other. Biggs made his bed, now he has to sleep in it.

Hand #1- Thinks all this does is create a person who if they were not 100% into 6 Jan but were the weekend warrior who really did get caught up in a moment along with many others who had been stoked/incited to a fevered pitch by DT and several other congress members just hours earlier after the years of hate hate hate from the gop hate machine. If they were not committed they will be after a decade + in a jail.
Hand #2- These people tried to steal my vote by following a man who took an oath and also wanted to steal my vote after losing 1 million + Americans while telling us disinfectant injections might help + hush payments, Russia, everything else the pos DT did
that is who they followed and had they been successful I believe some members of Congress would be dead and they would have destroyed our Democracy. Put them away for life, twice, just to be sure.
This would be much more palatable if the DOJ and all that that entails had made examples out of a pos ex-president, several congress members and various other significant backers of this horrible act that cost several lives that day and immediately following first instead of a bunch of people that unfortunately a significant number of Americans identify with and have sympathy for. Then seeing this person cry while talking to his daughter in court would have no power.
Oh well. This is the path chosen and its much too late to start over.

Judge Kelly agreed with the government that the Terrorism Enhancement was appropriate to add to his guidelines, which was an early blow to Biggs at his sentencing. This resulted in a sentencing guidelines range for Biggs of 27-33 years. These guidelines, however, are advisory so the court was not required to sentence Biggs within that range.
The government urged the judge to sentence Biggs to the top of the guidelines of 33 years while the defense was asking for several months in prison followed by probation.

Jones said he spent $500,000 to make Jan 6 happen. Steve Bannon was sure the hell instigating and leading. Roger Stone was with the Oath Keepers and Proud Boys in the days around Jan 6. And how about the RW Hate Talkers who deliberately lied and sent these saps to storm our Capitol?
If this guy is guilty (and he is), then these other guys should get at least the same treatment.

(17,407 posts)Going to jail might be the best thing you can do for them. The daughter may ponder the meaning of violent, arrogant, extremist tendencies and choose a better man than you for a husband, so that she wont see her own kid go through this,
Maybe your wife will find a man who isnt so easily duped, someone who is more respectful (in action, not words) toward God and country and wife and child.
So dont fret. No one is completely worthless, because even the worst people can serve as role models for what NOT to do.
