Judge orders Ivanka Trump to testify in $250 million fraud case

The judge overseeing the $250 million civil trial against Donald Trump and his company ordered the former president's daughter Ivanka Trump to testify in the case. Judge Arthur Engoron said Friday she could not be called as a witness before Nov. 1, giving her time to appeal the ruling if she chooses.
Trump's attorneys had challenged New York Attorney General Letitia James' subpoena to Ivanka Trump, noting an appeals court had ruled earlier this year that she should be dropped as a defendant in the case over statute of limitations issues. They contended the New York attorney general's office was trying "to continue to harass and burden President Trumps daughter long after" the appeals court "mandated she be dismissed from the case."
They also contended that the AG waited too long to subpoena her, and argued the office doesn't have jurisdiction over her because she no longer lives in the state. The AG's office contended that Ivanka Trump, a former White House official, still has information important to their case.
"While no longer a Defendant in this action, she indisputably has personal knowledge of facts relevant to the claims against the remaining individual and entity Defendants. But even beyond that, Ms. Trump remains financially and professionally intertwined with the Trump Organization and other Defendants and can be called as a person still under their control," the AG contended in a court filing.

Now if she commits perjury or contempt of court, then she'll qualify for some jail (not prison) time. I don't see her committing contempt, though, and she's probably just smart enough to take the fifth rather than lie.

Ms. Trump has clearly availed herself of the privilege of doing business in New York, Engoron said.
The judge also said Ivanka Trump should have submitted an affidavit asserting that she does not live or work in the state presently. Only she can tell us that, and its too late to do that now, Engoron said.
Following his decision, Engoron quickly denied a follow-up request from Donald Trumps attorney Chris Kise to entertain a deposition from Ivanka Trump taken in Florida. We want her here in person, Engoron said, noting that he prefers to hear testimony live in court....................

(128,918 posts)While she doesn't have to testify regarding crimes she might have committed, in a civil trial the fact that she took the Fifth can be commented on and inferences drawn. And since this is a court trial and not a jury trial, it's even less of a big deal.

(114,372 posts)which is starting to look really ridiculous since she's over 40, that "daddy's little girl" act. I think the prosecutors know that behind it is a woman who is hard as nails when it comes to money and that her claim, which will be that she didn't know what daddy made her sign, is ludicrous.
It will be fun to watch.

(4,741 posts)If she did something in that state related to the case, then they have jurisdiction over the incest twit. If I live in California, but do something for which I can get sued in New Jersey, New Jersey absolutely has the right to subpoena me to testify.
Only the dumbest and most desperate lawyer(s) would ever consider trying that rubbish.

Gaddammit, these people must be found guilty and be made to pay for their crimes. If they get away with their crimes the damage to our system of justice will be vast and permanent. They will have shown the country that our system is not set up for justice, but for those who have money.
