US appeals court keeps California assault weapons ban in force

LOS ANGELES, Oct 28 (Reuters) - A U.S. appeals court ruled on Saturday that California's assault weapons ban will remain in force while the state attorney general appeals a lower court decision declaring the 30-year-old measure unconstitutional.

A divided three-judge panel of the 9th U.S. Circuit Court of Appeals blocked the injunction issued last week by U.S. District Judge Roger Benitez in San Diego from taking effect while the case remains under review.

The panel also unanimously agreed that state Attorney General Rob Bonta's appeal in support of the gun law would be heard on its merits on an expedited basis.

Siding with gun rights advocates, Benitez ruled on Oct. 19 that assault weapons prohibition deprived law-abiding citizens of semiautomatic firearms like the AR-15 in violation of the U.S. Constitution's Second Amendment right to "keep and bear arms.

You’ve heard of the Three R’s. (Reading, wRiting, & aRithmatic).

The Three D’s. (Doom, Defeat, & Destruction).

The Three C’s. (Of marketing - Customers, Competitors, & Company).

There’s also three P’s of marketing: market skimming pricing, market penetration pricing and neutral pricing.

Even the three P's of diabetes. (polydipsia, polyuria, and polyphagia).

And the Three P's of Love (directed at men, anyway): Profess, Provide, and Protect.

Well, now, how ‘bout the Three G’s? Get Guns Gone.

I've been thinking about this........The 2nd does not specify what kind of, "arms." If we go with the original intent, (which has been totally bastardized), everyone would have to go back to muskets.

No mass shooters, for sure.

And once again ignoring the other part of the 2nd - belonging to a well regulated militia

Besides, if CA decides it will enforce its law, what can the SC do, if it rules for the NRA? They have no enforcement, and there ar eno penalties. And CA, being the 4th largest economy in the world, can just say "Screw you, we're going to stop this slaughter. And BTW, if you guys like guns so much, why won't you let people bring them into the US Capitol?".

District of Columbia v. Heller, 554 U.S. 570 (2008). The Supreme Court was, of course, incorrect but it has held that the Second Amendment creates an individual right not dependent on participation in a militia.

Until there is a new majority on the Supreme Court, the "well regulated militia" provision is meaningless.
