Georgia prosecutor to appeal dismissal of some Trump election case charges

WASHINGTON, May 23 (Reuters) - Georgia prosecutors on Thursday said they would appeal a judges ruling dismissing some criminal counts in the 2020 election subversion case against Republican presidential candidate Donald Trump and several of his allies.
Fulton County District Attorney Fani Willis, the prosecutor overseeing the case, said a state appeals court's decision to take up Trumps bid to disqualify her office from the case also allows the court to review other rulings.
The case is one of four criminal prosecutions Trump faces as he seeks to unseat Democratic President Joe Biden in a Nov. 5 election rematch.
Willis indicated she would ask the appeals court to overturn Judge Scott McAfees March ruling tossing out six counts, including three against Trump, that accused defendants of soliciting Georgia officials to violate their oaths of office. McAfee said the indictment was not detailed enough to sustain those charges, but left the remainder of the case intact.

In a filing to the Georgia Court of Appeals, the DAs office challenged an order issued in March by Superior Court Judge Scott McAfee, who dismissed counts lodged against Trump, former New York City Mayor Rudy Giuliani, lawyer John Eastman, former White House Chief of Staff Mark Meadows and attorneys Ray Smith and Bob Cheeley. In his nine-page decision, McAfee said those charges lacked sufficient detail.
Under Georgia law, the DAs office is permitted to bring this challenge called a cross appeal because Trump and other defendants are appealing another decision by McAfee. That ruling allowed DA Fani Willis to remain on the racketeering case so long as her former romantic partner, then-special prosecutor Nathan Wade, resigned. By submitting its notice on Thursday, the DAs office met the filing deadline to pursue the cross appeal, said Atlanta defense lawyer Andrew Fleischman, who is closely following the case.
