WASHINGTON A federal judge sentenced a former New Jersey electrician to 12 years in prison Friday for assaulting at least a half dozen officers during the Capitol riot.
Christopher Joseph Quaglin, 38, of North Brunswick, was convicted last July of 14 counts, including 12 felonies, in a stipulated bench trial. The charges include six counts of assaulting police, two counts of robbery and one count of obstructing an official proceeding.
Federal prosecutors sought 14 years in prison for Quaglin describing him as among the most violent members of the mob on Jan. 6. In a sentencing memo, they said he was part of the first breach of bike rack barricades and spent more than three hours wreaking havoc on the west side of the U.S. Capitol.
On at least a dozen occasions, Quaglin stood face-to-face with officers as he screamed at, pushed with outstretched arms, punched, swatted and slapped officers; pushed bike racks into officers; and even choked one officer to the ground, prosecutors wrote. Prosecutors said Quaglin also sprayed multiple officers with chemical irritant, including spraying at least one officer who was not wearing a gas mas or face shield directly in the face.

IMHO: Minimum sentence for anybody who beat up the cops and/or breached the building on Jan 6th should be 5 years. The traitors who plotted and abetted the crimes should get life.

Do prosecutors ask for more than they really want hoping the judge will hit the number they wanted in the first place?

(3,103 posts)It's usually a range that's calculated by a codified formula that takes many factors into account. However there are exceptions when an upward or downward departure from that range occurs.

(3,103 posts)within the guidelines range that the judge is bound to. They will argue over and try to negotiate the points values that are used to calculate the range, but once determined, the sentence must fall within that calculated range.

(3,544 posts)circumstance. Most of the lighter sentences seem to be because it's a first offense from what I've read. This is likely an exception because of either the aggravating circumstance of how violent he was or because he had priors.
I totally agree that the minimum should have been 5 for participating in an insurrection and the conspirators should have gotten life. THAT is reasonable. Perhaps the next time we control congress, we push for a new law that makes this the minimum for violence against the government.

(97 posts)The federal sentencing guidelines are just advisory. In fact, some judges aren't very amenable to what they view as the legislative branch trying to circumvent the discretion of the judiciary. Judges are supposed to consider guidelines when they determine a sentence, but they absolutely are not bound to them. Judges have complete discretion to give a sentence that's anywhere within the term allowed by the statute for the severity of the offence, regardless of what the guidelines recommend.
Defendents can appeal the sentence of course if they believe it's extreme, but this is usually if they receive a sentence that differs significantly from what others have been given in similar circumstances, and rarely because they differ from the guidelines.

Usually a departure occurs when there is some significant extenuating circumstance that the judge considers, and uses to justify making the exception. Departures are always considered with an eye on the inevitable appeal. But the vast majority of sentences fall within the guidelines, almost always. The language "bound to" is used, but it is not strictly accurate in that sense. The mechanics of the process are spelled out in detail in the links I posted above.

WASHINGTON (AP) -- A New Jersey electrician who repeatedly attacked police officers during the Jan. 6, 2021, siege at the U.S. Capitol was sentenced on Friday to 12 years in prison by a judge who called him "a menace to our society."
Christopher Joseph Quaglin argued with and insulted U.S. District Judge Trevor McFadden before and after the judge handed him one of the longest prison sentences among hundreds of Capitol riot cases. ... "You're Trump's worst mistake of 2016," Quaglin told McFadden, who was nominated to the court by then-President Donald Trump in 2017.
Quaglin, 38, joined the mob of Trump supporters who stormed the Capitol. He injured a police officer when he choked and tackled him to the ground. Quaglin assaulted other officers with stolen police shields, metal bike racks and pepper spray. He clashed with police for roughly three hours while wearing an American flag-themed "Make America Great Again" sweatshirt. ... "What an outrage. What a disgrace," the judge said.
Quaglin complained about his jail conditions and pushed conspiracy theories about the Jan. 6 siege during his rambling remarks in the courtroom. He also took issue with labeling the Jan. 6 attack as an insurrection.... "If I wanted to bring an insurrection, I would have brought a long gun," he said. ... The judge, who cut him off after several minutes, told Quaglin that his combative remarks were a "really bad idea" before sentencing. ... "It's a kangaroo court," Quaglin responded.

The FCC needs to get a grip on these cable TV and radio stations and make it against the law to encourage insurrection. When they wrote those laws cable news was in its infancy. Times have changed.
I know free speech and all that but really? They are calling out for violence against Biden and Harris every damn day? The only way they will change it is when Trump wins and WE use it against them.

We cannot breach any topic except work to these fools. Frankly it all sickens me. I'm one of the LGBT demographic they secretly bash, actually fantasize about my extermination en masse.
Reassured as I am by the majority of sane folks at work, dammit I can't afford to retire in Mexico yet. This project 2025 Nazi shit scares the hell out of me. I can't even finish "Prequel" by Rachel Maddow without causing myself digestive issues. I can only stomach limited amounts of bias confirmation reading on DU with the PTSD thoughts of reliving my bullied youth from these crazies who've gone off the rails now.
I truly believe there's a lead poisoning epidemic of these masses of unfiltered tap water glugging fools.
