McIver files appeal after judge rejects effort to dismiss charges against her

Rep. LaMonica McIver (D-N.J.) on Monday appealed a judges order allowing her criminal prosecution to proceed. McIvers notice of appeal begins her fight at the U.S. Court of Appeals for the 3rd Circuit, which hears federal cases arising from New Jersey and will consider the congresswomans arguments in the coming months.
This appeal is for everyone who is standing up to this administration as they try to operate without oversight, silence the people who oppose them, and shut down those who protect the vulnerable, McIver said in a statement announcing the appeal. They want to make an example out of me, but I will not let them. I will not be bullied out of doing my job and protecting our communities, she continued. Not now, not ever.
McIver faces three felony counts of assaulting, resisting, impeding and interfering with a federal officer. The criminal prosecution stems from McIvers May visit to an Immigration and Customs Enforcement (ICE) detention center.
Federal law enables members of Congress to conduct oversight visits to ICE facilities, but the Justice Department has accused her of assaulting agents outside the Newark, N.J., center amid the arrest of the citys Democratic mayor, Ras Baraka.
