Wisconsin Abortion Law Signed By Gov. Scott Walker Blocked By Judge

MADISON, Wis. A federal judge issued a temporary restraining order Monday evening to block enforcement of a new Wisconsin law that bans doctors who lack admitting privileges at nearby hospitals from performing abortions.
U.S. District Judge William Conley granted the order following a hearing in a lawsuit filed Friday by Planned Parenthood of Wisconsin and Affiliated Medical Services. It alleged the requirement would unconstitutionally restrict the availability of abortions in the state, violates the U.S. Constitution's due process guarantee and unconstitutionally treats doctors who perform abortions differently from those who perform other procedures.
The restraining order will remain in place pending a fuller hearing July 17. In his ruling, Conley said "there is a troubling lack of justification for the hospital admitting privileges requirement." He said the U.S. Supreme Court has ruled that states must prove that restrictions on abortion rights must be reasonably aimed at preserving the mother's health.
"Moreover, the record to date strongly supports a finding that no medical purpose is served by this requirement," he said.

(2,205 posts)And we have got to stop calling him a "pro-lifer". He is NOT pro life, he is pro birth. So long as it's born that's all that matters to him.
If he were truly pro life he wouldn't fight so hard against the programs that help those in need or trying to cut medicaid like he recently did. His attitude is "Once its born---Its your Problem".

(346 posts)Writing these unconstitutional laws, and the courts keep on overturning them. Why not put all of that effort into something useful, like some sort of jobs legislation?

I mean, all these laws (not just abortion related) that are blatantly unconstitutional from the get go. And they know it too.
They really cannot deal with losing elections, can they? They're gonna do what THEY want....and show you!

These legislators shouldn't be allowed to pass laws that impact health when they are so clearly unqualified. They need to stop trying to judge, punish and force their religious beliefs on women!

(17,200 posts)There's been a lot of this going around lately, notice? Some GOP legislature passes a ridiculous bill, some judge issues an injunction, the legislature appeals and makes mouth-noises of outrage about Balance of Powers, and so on and so on and scooby-dooby-dooby.
This is actually the system working. One of the ideas behind the Separation of Powers concept was that if one branch of the government is overrun by yahoos, the other branches can restrain its worst excesses until the voting system can restore the balance. While I happen to think there's a bit too much of the "Invisible Hand" in that conception, it certainly is being played out in this century.
