Boston Bomb Suspect’s Friends Indicted by Grand Jury

Source: Bloomberg

By Erik Larson - Aug 8, 2013

Two 19-year-old Kazakh friends of Boston Marathon bombing suspect Dzhokhar Tsarnaev were indicted by a federal grand jury with allegedly hindering a federal probe in the days after the April 15 attack.

Dias Kadyrbayev and Azamat Tazhayakov, both Kazakhstan citizens who were living in Massachusetts on student visas, were charged today with conspiracy to obstruct justice and obstructing justice with the intent to impede the bombing investigation, according to a statement by U.S. Attorney Carmen Ortiz in Boston.

Kadyrbayev and Tazhayakov are accused of removing a backpack containing fireworks from Tsarnaev’s college dormitory room on April 18 after authorities released pictures identifying him as a suspect in the attack that killed three people and injured more than 260 near the race’s finish line. They also agreed to dispose of the bag to protect their friend, the U.S. said.

However, given the horrible nature of the bombings, public pressure may demand that the prosecution seek more than the usual pound of flesh.

On the evening of April 18, 2013, KADYRBAYEV showed
TAZHAYAKOV a text message he had received from
DzhokharTsarnaev, which read,

If yu (sic) want yu (sic)
can go to my room and t
ake what’s there☺ but ight (sic) bro (sic)
Salam aleikum
.

KADYRBAYEV,TAZHAYAKOV,a co-conspirator known to the
Grand Jury,and Dzhokhar Tsarnaev
all began attending the University
of Massachusetts at Dartmouth (“UMASS-Dartmouth”) at the same time
in 2011.
The four men were friends, spent time together socializing,
and often exchanged text messages with each other.

KADYRBAYEV, TAZHAKAKOV, and their
co-conspirator entered Dzhokhar Tsarnaev’s
dormitory room,

KADYRBAYEV placed Dzhokhar Tsarnaev’s backpack
, which contained several items including
fireworks and a jar of Vaseline, in a garbage bag

8. So after a 4th interview the third guy remembers going to his room and now is not indicted

Phillipos "initially said that he did not remember going to Tsarnaev's dormitory room on the evening of April 18" with Tazhayakov and Kadyrbayev, saying he was asleep at their New Bedford apartment, the complaint states. But in a fourth interview, on April 26, admitted to investigators that the three had gone to the dorm room, seen seven red tubular fireworks in Tsarnaev's backpack.and then disposed of the bag.

In the statement announcing the indictment, prosecutors referred to a third person, whom they did not identify.

However, the person is Robel Phillipos, who has been accused of lying to FBI agents investigating the aftermath of the bombing. Phillipos has not been indicted, and court papers filed Thursday indicated that his attorney and the government were in negotiations to deal with his case.

Phillipos is under home confinement and must wear an electronic bracelet, federal officials said.

7. "take what's there" w/ smiley face indicates Tsarnaev +2 were in cahoots
Thu Aug 8, 2013, 11:07 PM

Otherwise, why the smiley face? Why did the two take the laptop and backpack, and not his clothes and shoes?

If a friend texted me to "take what's there" I'd be wondering what he's talking about. I wouldn't know to take a backpack and laptop unless that was specified---or unless I knew ahead of time what "what's there" meant.

These 2 look guilty as hell so far.
