Herring's Va. attorney general edge 163 votes after Fairfax count

Mark Herring's statistically miniscule edge over Mark Obenshain in the attorney general race grew to 163 votes Tuesday evening as a midnight deadline approached for localities to finish counting ballots and report their tallies to the state.

That updated count came after the Fairfax County Electoral Board finished tabulating provisional ballots, leading several Democrats to declare Herring victorious after a week of fluctuating returns since last Tuesday's too-close-to-call election.

(Fairfax's numbers were widely reported Tuesday evening on Twitter, leading several people to declare Herring victorious, though they had not posted to the State Board of Elections web site as of 9:45 p.m.)

Herring was similarly emphatic about the outcome Tuesday night: "The margin was close, but it is clear that Virginians have chosen me to serve as the next Attorney General."

Because when my GOP neighbors are upset, things like the economy, progress, prosperity, shrinking deficits are soon to follow. And right now their heads are about ready to explode. "Doomsday 2009, 2010, 2011, 2012, 2013, 2014 is just around the corner. Mark my words."

Fortunately election integrity sleuthing discovered the dropped votes and Twitter enabled the communication needed to bring the problem to light just in time to prevent the election from having a switched outcome.

Without the activists scrutinizing the results statistically for anomalies and without Twitter, this election would have been won by the Republicans.

Virginia Democrats Raise Concerns Over Ken Cuccinelli's Role In Possible Attorney General Recount

.... The State Board of Elections updated the count to reflect provisional ballots from Fairfax County. Herring now leads by 164 votes out of more than 2.2 million cast.

Herring had declared victory late Tuesday night, saying "voters in Virginia have spoken." ... Obenshain termed Herring's declaration "bravado" ......

Obenshain said talk of a recount is premature, pending the Nov. 25 vote certification by the State Board of Elections.


Obenshain also said he is not concerned about conflict of interest questions Democrats are raising because Attorney General Ken Cuccinelli is calling on supporters to help fund Obenshain's potential recount. Cuccinelli's office advises and counsels state agencies -- including the elections board, which would be in charge of a recount.

State Sen. A. Donald McEachin, D-Henrico, on Wednesday called on Cuccinelli to "stop tainting the electoral process and to refrain from fundraising for Senator Obenshain." ........
