ACLU lawsuit challenges Wisconsin same-sex marriage ban

Four same-sex couples sued Gov. Scott Walker and other public officials Monday in an attempt to overturn the state's seven-year-old ban on gay marriage.

The move comes amid a wave of challenges nationally — many of them successful — to overturn limits on gay marriage.

It also comes as the state Supreme Court considers whether a limited set of benefits available to gay couples under Wisconsin law is acceptable under the state constitution's prohibition on same-sex marriage and civil unions.

The lawsuit contends that Wisconsin's ban on gay marriage violates the U.S. Constitution's guarantee of due process and equal protection under the law. It also challenges the state's "marriage evasion" law that makes it a criminal offense for a couple to seek a marriage from another state that is prohibited in Wisconsin.

The Tea Party has all 3 branches of the Government in Wisconsin

The Wisconsin Judicial Commission brought an ethics charge against Justice Gableman.

The charge alleges that a campaign advertisement in which he accused Butler of working "to put criminals on the street" and accusing Butler of finding a "loophole" that resulted in the release of a child molester, was false and misleading.
Gableman has claimed in his defense that his free speech rights are violated by the judicial conduct rule he is accused of breaking.
