APNewsBreak: Police say teacher acknowledged sex

A California educator jailed on felony charges of sex abuse acknowledged to police that she had a sexual relationship with a former student who confronted her over the phone and posted video of the conversation on YouTube, police said.

In court papers obtained Tuesday by The Associated Press, Riverside police Detective Roberta Hopewell said that 40-year-old Andrea Cardosa told Alhambra police she had a sexual relationship with the now-28-year-old woman who made the video when the alleged victim was a teen.

The officers interviewed Cardosa after the woman sent a link to the video to the principal of Alhambra High School, where Cardosa was an assistant principal, Hopewell wrote in a declaration in support of an arrest warrant for Cardosa filed in Riverside County Superior Court.

"During the interview, Cardosa admitted to having sexual relationship with Jane Doe (hash)1," Hopewell wrote.

I was molested as a child, for years. That doesn't give me a pass to go out and molest others. If anything, it makes me even more aware of the problems and harm it can cause.

If she was molested as a child, I'll extend her a bit of pity over it, but it shouldn't impact this case one bit. She did what she did as an adult, and made her own choices.

Put her away. Don't let her harm anymore children, she messed this woman up terribly bad. She was so upset that the woman was still 'helping' kids, I could see her shaking.

It will help in her healing. I do hope this woman faces justice, but will this be enough to bring charges and a verdict if the statue of limitations has run out on the act?

For child molestation cases that occurred after 1991, the California statute of limitations is 10 years or 1 year after it is initially reported to law enforcement, whichever is later. That essentially means that there is NO statute of limitations for child molestation, as long as the prosecutor files charges within a year of the victim reporting it.

I've seen it reported that the victim is now 28 years old, which would have made her 6 years old when the law changed. Most articles say the molestation continued until her later teens, which means it falls well within the new standards. The one year clock didn't start ticking until after she posted the video to YouTube and the police began their investigation.

The only way she could worm out of this would be to convince a jury that it was NOT child molestation, but was statutory rape (which has a shorter 3 year statute of limitations). Because her victim was only 12 when the abuse started, I don't see any reasonable juror buying that.

The details given in the linked story are ... pretty scant, and the use of the term 'sexual relationship' somewhat confuses the matter.

But if you're correct, then this case is obviously and irrefutably highly egregious, and I don't think statutory is even an 'option', legally or otherwise.

It's odd because many other articles say the abuse started at 12 ... not sure if that's because in the infamous 'recording', Carrillo says she was 12 when they met, or what. Also, the charges against Cardoza make mention of "lewd acts with someone < 14 yo"

So ... it's confusing, deducing the actual accusations, but it'll be massively important in terms of the severity of punishment.

The article also included some chilling photos of the rapist and her victim ... my apologies in advance if anyone finds these painful to see.

In the first picture, it appears the young victim has been supplied (plied, as they say) with booze, presumably by her of-legal-age attacker. Amazingly it looks like it's happening at a restaurant.

Although, on second glance, it looks like maybe their hands are interlocked next to the Corona bottle, which maybe means the alcohol is not in the hand of the youngster as it first looked, which could mean it actually belongs to the adult. We can hope for the best, anyways.



The second seems to be from one of those photo booth thingies in which couples take goofy pictures while on dates ... super creepy. Makes you wonder what kind of threat the child was under to 'smile for the camera' like this as she sat on the lap of her attacker. There's probably some 'Stockholm Syndrome' going on too ... absolutely heartbreaking to see.



I hope Ms. Carrillo joins Ms. Govea's case against the school district for allowing this to happen & it pays these young ladies big dollars. I know there's no possible way to make her whole after an ordeal like this, but a few million dollars should at least make her life a little easier, and pay for the very best counseling going forward.
