Kentucky trooper wants job back because raping that girl was just a ‘moral mistake’

A Kentucky state trooper told a trial board last month that he would like to have his job back after he was fired for having sex with a 15-year-old girl, calling the relationship a moral mistake.
In a transcript obtained by WDRB, former Kentucky State Trooper Jerry Clanton asserted to the Kentucky State Police Trial Board that he was under the false impression that the 15-year-old girl was 18 years old when he started having sex with her.
I made a moral mistake. And, Ive gotten right with my family, the married former trooper insisted. I recognize that it is an embarrassment to the State Police. But I have not compromised myself in the fact that, in my mind, all I was doing was making a moral mistake.
I would never have gone over there. I would have never spoken to her, never texted her, never anything had I thought she was anything but 18.
KSP Commander of Legal Services Capt. Matt Feltner, however, felt that the incident was more serious.
You cant put a 15-year-old girl in a car, drive her up in the middle of nowhere and have sex with her, Feltner said. I mean that doesnt have to be written out somewhere to know its completely wrong and outside the lines.
During the hearing, Clanton explained that State Trooper Stratford Young had sex with the girl first, which he said resulted in his inappropriate relationship.
Clanton admitted to having sex with the girl on at least four separate occasions, once on the trunk of his police cruiser while it was pulled over on the side of the road.
I didnt intend on having sex with her, he said.
In the end, the trial board declined to give Clanton his job back.
Investigators believe that a Brandenburg officer and a Breckinridge County Sheriffs deputy also had sex with the girl.
None of the four men had been charged as of Wednesday. According to WDRB, the girl is angry that no one is in jail. Her father has also called on prosecutors to take action, but it would be up to a grand jury to decide if anyone will be charged.

He was "intending" to cheat on his wife and didn't bother to run a DMV check on his "intended"?
Cops cheat, it comes with the job. I mean, the overwhelming majority of them cheat. Very few do not succumb to the temptation sometime in their career, and it's part of the "unspoken covenant" to cover for any copper stepping out on his/her spouse.
And, they all use departmental resources to check the background of their paramours. He KNEW she was underage and felt that he was privileged to ignore it.
Cause he was a cop.

My point is that he certainly would have tried to check her through DMV (as well as checking for a criminal record) and should have been suspicious of her age due to the lack of record.
No driver's license should have been a big indicator that he needed to research further before committing adultery with this girl. The tools are there and I asure you that police officers (notorious for philandering) avail themselves of those tools on a regular, presumptive basis.
This bufoon was less diligent checking out his intended paramour than he would have been on a traffic stop.
Or he's a liar that got caught committing premeditated statutory rape.

(11,998 posts)and if that were the case, he might only be an adulterer instead of a rapist, which is generally not a job-killing offense, though it may be a marriage-killing one.
Since the age of consent in KY is 16, and the girl was 15, if he is only losing his job, it seems to me he is getting off easy, for having gotten off easy.

These guys knew what they were doing. And swapping her around? They freaking knew and there's no way these guys didn't take some sort of souvenir.

"Adultery" is between him and his wife, sex while on duty is between him and his employer, which in this case is the public.

Well if he was asking to go back to work at Burger King, maybe. Third, he is obviously dumb as a board as proven by his testimony. I would hope that would eliminate him from working for law enforcement. Fourth, he thinks it's more important to "make it right with his family" than the victim and victim's family. (I am curious why he hasnt been taken out in the woods and spoken harshly to, by her family. Just sayin) Fifth, he thought she was 18. Did I mention this guy is an idiot?
And I bet he gets to continue carrying a gun.

So it's clearly not that the original trooper was dating her. Why did he feel it necessary to drive to the middle of nowhere? Clearly he knew it was wrong at the time or doing it.
Send him to jail.

(13,184 posts)This appears to be a case of statutory rape, in that there is no suggestion I've seen of coercion or force.
I'm not sure that it's a good thing to elide the difference between sexual contact that is a crime because of age (statutory rape) and forcible rape.
That cop is still a sleazeball, though, and violated the law. He shouldn't get his job back, and I don't understand why he and the others aren't being prosecuted for statutory rape.

"Criminal laws deal with the legality of sexual acts. Statutory rape laws assume that all sexual activities involving individuals below a certain age are coercive. This is true even if both parties believe their participation is voluntary. Generally, statutory rape laws define the age below which an individual is legally incapable of consenting to sexual activity. To complicate matters, few states use the term statutory rape in their criminal codes. More often, a states code will address legality of different sexual activities involving minors (e.g., sexual contact versus penetration). Sometimes it is difficult to identify the applicable laws because they are often embedded in the section of the code dealing with other sexual offenses (e.g., sexual assault, forcible rape)."
I do note that the summary says that few states use the term in their criminal codes.

(16,191 posts)Rape is any case in which consent is not given. In most cases, it's because the victim cannot give consent or chooses not to. In the case of statutory rape, it's because the victim was legally prohibited from doing so.
If no consent occurs, then it's rape. The fact that she was a willing participant is irrelevant.
The differences between statutory and forcible rape are reflected in the sentences handed down for each, but the fact that states treat it as a lesser offense doesn't change the fact that it's still rape. No consent was legally given.
