Credit Suisse helped wealthy Americans cheat the IRS, Senate report says

Swiss banking giant Credit Suisse helped wealthy Americans hide billions of dollars from U.S. tax collectors for several years and federal prosecutors have done little to hold violators accountable, according to a U.S. Senate subcommittee report due out Wednesday.

The allegations were particularly stunning in the face of the budget cuts and deficits that the United States faces, lawmakers said. The report casts the Justice Department as a hapless enforcer that has dragged its feet in getting Credit Suisse to turn over the names of some 22,000 U.S. customers.

Lawmakers have accused the bank of helping wealthy Americans avoid paying taxes on as much as $12 billion in assets held at the institution. Prosecutors have been aware of the misconduct at Credit Suisse for at least four years, in which time they have indicted seven bankers and launched a probe of the institution, according to the report. But no one has stood trial, and the bank has not been held legally accountable, the report says.

The 175-page report, the culmination of a two-year investigation, alleges that from 2001 to 2008 Switzerland’s second-largest bank helped customers disguise Swiss accounts by opening them in the name of offshore shell entities. Bankers used cloak-and-dagger tactics to conceal their misdeeds, according to the report.

Our laws apply to the USA. The DOJ arrested American bankers and crooks, within our jurisdiction. I doubt the EU and other nations care about what our tax evaders did.

The fabled 'American Empire' is a sexy idea and not a reality. We don't rule the world and never did. We even had to pay Britain money as part of the terms of our independence.

There are ways to get around paying taxes. The only people stuck paying taxes are those who must pay them up front. The rest just take the money and run. Nothing new there.

Best the USA government was able to do was to grant amnesty from prosectution to individuals willing to pay their back taxes with a penalty.

The hard core ones just keep on moving that money out of range. If they can get CS to turn on their clientele, fine, but that was tried before. We have no way to force a foreign nation to hand over the money.

It took years to get the stolen money they held for the Nazis paid back. If American laws were able to go after foreign countries, it'd be one thing.

This is done by diplomacy and by threats to reputation. Now on that score, since the British went after their tax evaders and the Pope called not paying taxes a sin, or something in very strong language, they may feel the heat and hand their client's information over.

It'd be delicious to get these robbers to pay up. But it ain't just our decision, we have to get something to go along.

This story just might do it...

Switzerland changed its banking secrecy laws, at least insofar as it applies to Americans.

Swiss banks must now legally report to the IRS certain information about accounts which previously they did not have to.

In fact, I believe that it is now much more difficult for Americans to set up bank accounts in Switzerland, and existing ones have mostly been closed.

Can a Swiss national go home and escape American justice? Yes.
