Appeal of Keystone XL ruling will be argued Sept. 5

LINCOLN The states appeal of a ruling that struck down the law used to route the Keystone XL pipeline will be argued Sept. 5 before the Nebraska Supreme Court.
A Lancaster County district judge ruled in February that a 2012 law unconstitutionally bypassed the State Public Service Commission when it gave Gov. Dave Heineman the power to approve the pipeline route. Three landowners opposed to the Keystone XL challenged the law.
Attorney General Jon Bruning has appealed the district courts decision. In a legal brief, Bruning argued the landowners failed to show they were injured as taxpayers.
A high court ruling is not expected until late this year, most likely after the November general election. President Barack Obama has suspended his review of the project pending the outcome of the Nebraska appeal.
