Gay Marriages Allowed to Proceed in Idaho

WASHINGTON — The Supreme Court on Friday allowed same-sex marriages to proceed in Idaho, lifting a temporary stay issued two days earlier by Justice Anthony M. Kennedy.

The developments capped a busy week for gay rights. It started with the court’s refusal on Monday to hear appeals from decisions striking down same-sex marriage bans in Indiana, Oklahoma, Utah, Virginia and Wisconsin. The next day, the United States Court of Appeals for the Ninth Circuit, in San Francisco, struck down bans in Idaho and Nevada.

The Supreme Court’s orders this week allowed same-sex marriages to proceed in all seven states, raising the number of states in which such unions are lawful to 26, along with the District of Columbia. The legal ripple effects from the various appeals court rulings the Supreme Court tacitly sustained should soon raise that number to 35.

And we won!

People told us for years that it couldn't be done.
People told us for decades that it would never happen here in Idaho.
People told us that we were wasting our time, and that we should spend our time and energy on other social issues.

A lot of people felt that way here in Idaho.
Some were even sympathetic to the cause, but they had no hope of ever getting some of the bad laws in Idaho changed.

The Republicans had passed a law in the state legislature back in 2004 outright banning gay marriages, but that law was quickly struck down as being unconstitutional.
But, you know how those sneaky Republicans are . . . if they don't succeed the first time with a crummy, rotten law, they will come back with a different stinky bill written a little bit differently in order to pass the smell test.
So, in 2006 the Republicans rammed a bill through the state legislature along party lines defining marriage as only being allowed to take place between a man and a woman.
And that law stunk to high heaven.

Oooh, they thought they were so clever by "defining" what a legal marriage is.
They would brag about how they got their bill passed into law and how "the devil is in the details" and then they would snicker to each other while saying their law defining marriage would stand for 1000 years.
It was "just common sense", they would say.
It even had biblical implications behind it, don'tcha know.

Nevertheless, this article from the New York Times goes deeper in to the analysis of why gay marriages will proceed in Idaho, and why that is an inescapable fact of life now.
It is inevitable.
Now, there's nothing the Governor of Idaho can do to stop gay marriages from taking place in Idaho in the very near future.

Whether or not Governor Otter decides to file an appeal to have the entire panel of judges on the 9th Circuit Court of Appeals to rehear the state's case to overturn the Appeal Court's decision last Tuesday that overturned Idaho's anti-gay marriage law, after a panel of judges from that court found Idaho's law banning gay marriages by defining marriage as only being legal if it occurs between a man and a woman to be unconstitutional . . it does not matter.

Whether Governor Otter decides to file a motion with the Supreme Court to hear the state's case in an attempt to overturn the 9th Circuit Court of Appeals decision after a panel of judges from that court found Idaho's law to be unconstitutional . . it does not matter.

The entire panel of Supreme Court judges lifted Justice Kennedy's stay on the 9th Circuit Court of Appeals' decision on Friday morning.
Just a few days after the Supreme Court had overturned similar laws banning gay marriages in other states.
The Supreme Court has made it clear how they view this legal issue.
This article clearly points that out.
It won't do Governor Otter any good to file a motion with the Supreme Court concerning that law.

The 9th Circuit Court of Appeals is not going to have the entire panel of judges rehear this case, either.
They have already spoken about how they view this legal issue.
So, it's a done deal.

The Governor of Idaho can not wait to act in order to allow gay marriages to take place in the state.
Governor Otter thought that he was being clever by saying that he would wait for the 9th Circuit Court of Appeals to direct him to allow gay marriages to take place in the state.
Justice doesn't work that way.
The enforcement of laws does not operate that way.
By the way, Otter graduated with a law degree from the University of Idaho.
So, that gives you some idea of what a totally inept attorney he is.

Because he can NOT wait for the 9th Circuit Court of Appeals to direct that the state of Idaho allow gay marriages.
This article clearly states that there are no more appeals to be made.
The state law defining marriage between a man and a woman was found to be unconstitutional.

But, Governor Otter is such a hugh moran that he thought he could pull that stunt and get away with it.
Ya know, he thought that he could just start a whole new round of legal appeals and tie it up in the courts for several more months, or even for a few more years.
And just keep putting it off, and putting it off, and putting it off.

Nope, the law doesn't work that way.
Now it's a done deal.
The battle is over.
He lost.

Too bad for him.
Because this issue came up in the first face-to-face debate he had with the Democratic challenger during Friday night's debate.
And Otter is so frickin' stupid that he defended that law even AFTER the law had been declared unconstitutional!
That's how bad of an attorney Otter is, he doesn't even realize who adjudicates which laws in this country are constitutional and which ones aren't!!
The same way he bragged at the 2012 GOP Convention that Idaho was the first state to sue the federal government over "Obamacare", just a few short weeks after the Supreme Court had already decided that the law was constitutional.

Despite all of these facts, despite the fact that the state's entire Republican party is in disarray here in Idaho, and there are just 3 short weeks before the mid-term elections, the Republican Attorney General of Idaho is going to file an appeal with the 9th Circuit . . anyway!

And he said he is also going to file a motion with the Supreme Court to hear the state's case . . anyway!

It's a waste of time.
It won't do him any good.
But that gives you an idea of what a poor attorney he really is, as well.
He doesn't even realize that he is already whipped!!


We are the ones we have been waiting for.

On Monday, Idaho state's Attorney General gave up his effort to appeal the decision of the 9th Circuit Court of Appeals.
