Ferguson Grand Jury Decision Reached

The grand jury hearing the case of Officer Darren Wilson and the killing of Michael Brown has reached a decision, CNN and The Washington Post reported Monday. The St. Louis County prosecuting attorney will hold a press conference later today announcing the decision. Missouri Gov. Jay Nixon is flying to St. Louis, a spokesperson said.

However, don't expect things to change. Police will continue to remain unaccountable, and citizens will end up dead.
Blacks will continue to be treated the same by police.
Nothing will change. And this story will become a footnote in a matter of months. Just like Trayvon Martin.

I was thinking along the same lines. It's a sort of "in the middle" decision.

It is obviously not going to be 1st Degree MS, which I understand since he will always have the "line of duty" defense against pre-meditation.

(338 posts)Theres a big difference between doing something by accident and doing it intentionally. This is the difference between involuntary and voluntary manslaughter. Voluntary manslaughter is more serious than involuntary manslaughter because it involves taking intentional action. Its separated from murder by your state of mind at the time. Murder typically involves some level of premeditation or it occurs in the process of committing another felony, such as robbery. Voluntary manslaughter is instigated by situations of extreme emotion, such as if someone provokes or betrays you and you react in fury or grief. A voluntary manslaughter charge might also come about if you use deadly force to protect yourself when, in fact, you misread the situation and deadly force wasn't necessary.

A voluntary manslaughter charge would send a message. I hope that is the result, but I doubt it.

(708 posts)12 total grand jurors are empaneled. At least nine must agree to hand down an indictment. If they cannot get nine to agree, then they must return no true bill.
If they indict, then the true bill goes to the presiding judge, who can, at least in theory, still throw out the indictment, but this is very rare indeed. Otherwise, it gets approved by the judge presiding over the grand jury and is then sent to a district judge for setting arraignment. Then it gets randomly assigned to one of several criminal judges for the trial.

(53,661 posts)There is a thread on how he was 138 feet and not 30 feet as stated before. I hope the Grand Jury took that into account. At 138 feet, it's not involuntary manslaughter as if in a fistfight situation as has been suggested. If Wilson was losing his mind and overreacting, that's not flat out murder. Like anyone with a gun, it should be used as a last resort, not a first resort. How could Wilson fear for his life or think Brown was a danger to others from 138 feet away? BTW, don't they have tasers?
I really want this to come to trial so that all the witnesses I saw on MSNBC this summer come forward and speak. Each one of them struck me as fair, honest and open-minded people, cognizant of justice for all parties and their duty to not bear false witness.
That is who I want to hear from, not all the fearmongers and hate groups.

(187 posts)I hope I'm wrong, but I think it is pretty obvious that there was never any intention on the prosecutors part to seek an indictment. I hope the protestors remain peaceful, but cause disruption. Cops are out of controll in this country and things will never change without conflict.
