ConAgra faults decision by labor board (NLRB)

ConAgra Foods engaged in unfair labor practices when it disciplined an Ohio production facility employee for talking to co-workers about union activity, a review panel found.

The National Labor Relations Board on Friday upheld a judge’s 2013 ruling, with one of three board members dissenting.

“We disagree with the board’s most recent decision,” ConAgra spokeswoman Monique Farmer said. “We are reviewing the details of that decision and considering next steps.”

The board ordered ConAgra to rescind a verbal warning issued to the employee and to clarify in a letter to employees that talking about a union during work time on the production floor does not constitute “solicitation,” an unprotected activity covered in the company’s policy and under the National Labor Relations Act.
