Appeals court won't delay or move Tsarnaev trial

Source: AP-Excite

BOSTON (AP) — A federal appeals court has refused to delay or move the trial of Boston Marathon bombing suspect Dzhokhar Tsarnaev (joh-HAHR' tsahr-NEYE'-ehv).

The 1st U.S. Circuit Court of Appeals in Boston issued its decision Saturday, saying defense attorneys haven't made "the extraordinary showing" required to justify a delay or change of venue.

The trial is scheduled to begin Monday in Boston.

Sorry for my stupidity. Do you know why all these requests for a venue change are being turned down? Yo_Mama Jan 2015 #4

to a change in venue. Neither of the federal trials for McVeigh or Nichols were conducted in Oklahoma.

I might not object to the move. I think wouldn't want to give the defense a issue to appel on.

It seems to me that it is usually granted in cases like this.

The court will interview numerous jurors and IF they can't find an impartial jury the court can then have a change of venue. The defense, most likely for more money, has tried to have this done without an interview of potential jurors first. This is the same thing that happened in the McVeigh and Nichols trials.
