What Clarence Thomas is going to do now

(CNN)"When people show you who they are, believe them."

The poet Maya Angelou said that to Oprah more than two decades ago, and it's become an often-repeated quote. But it's true for Supreme Court justices, too.

Since Clarence Thomas joined the Court in 1991, he's been its most fervent opponent of Roe v. Wade and the enshrinement of abortion rights. As he wrote in a dissenting opinion just two years ago, "Our abortion precedents are grievously wrong and should be overruled." Now, reinforced by the addition of three justices appointed by President Donald Trump, the Court has overruled Roe and Thomas's mission has been accomplished.

n today's decision in Dobbs v. Jackson Women's Health Organization, Thomas, in a concurring opinion, made his next goals just as clear: "In future cases, we should reconsider all of this Court's substantive due process precedents, including Griswold, Lawrence, and Obergefell. Because any substantive due process decision is 'demonstrably erroneous,' we have a duty to 'correct the error' established in those precedents." Griswold protected the right of married couples to buy birth control; Lawrence prohibited states from criminalizing consensual sex; Obergefell established a national right to same-sex marriage. Thomas is saying -- explicitly -- what he plans to do. Believe him.

For all his 30 years he never talked in public, never questioned the attorneys appearing to present their causes and all of a sudden, I was reminded of the famous phrase "Garbo talks."

But now that he has company in a protective majority, he feels free to be more of a swinging dick. His wife is just another radical voice screaming in his ear. Of course, she’s the one servicing that swinging dick….

That, we, the American people have a duty to "correct the error" of his appointment to the bench. His refusal to recuse himself from obvious conflict-of-interest cases, his refusal to uphold his oath of office and his perjury should have consequences.

5) Justice Clarence Thomas

Justice Clarence Thomas is the only current member of the Supreme Court who has explicitly embraced the reasoning of Lochner Era decisions striking down nationwide child labor laws and making similar attacks on federal power. Indeed, under the logic Thomas first laid out in a concurring opinion in United States v. Lopez, the federal minimum wage, overtime rules, anti-discrimination protections for workers, and even the national ban on whites-only lunch counters are all unconstitutional.

Though Thomas’s views are rare today, they have, sadly, not been the least bit uncommon during the Supreme Court’s history. He makes this list because, frankly, he should know better than his predecessors. As I explain in Injustices, many of the justices who resisted progressive legislation in the nineteenth and twentieth centuries were, like Field, motivated by ideology. Many others, however, were motivated by fear of the rapid changes state and federal lawmakers implemented in the wake of the even more rapid changes brought about by the Industrial Revolution. It was possible to believe, in a world where factories, railroads, and the laws required to regulate factories and railroads were all very new things, that these laws would, as Herbert Hoover once said about the New Deal, “destroy the very foundations of our American system” by extending “government into our economic and social life.”

But Thomas has the benefit of eighty years of American history that Hoover had not witnessed when he warned of an overreaching government. In that time, the Supreme Court largely abandoned the values embraced by Justice Field, and the United States became the mightiest nation in the history of politics and the wealthiest nation in the history of money.

As former Moonie-turned-cult-expert Steven Hassan watched the Capitol Riots unfolding last January, there was a familiar face among the thousands of MAGA supporters clamouring to overturn the 2020 election result.

Hyung Jin ‘Sean’ Moon, head of the far-right, AR-15-worshiping Rod of Iron Ministries and son of Moonie founder Sun Myung Moon, had joined Proud Boys and Oath Keepers to protest in front of the US Capitol. The group has been widely described as a cult.

The Rod of Iron Ministries posted a clip to its Instagram page showing Sean Moon wiping tear gas from his eyes while blaming the violence on Antifa.

The clip had particular resonance for Dr Hassan: he was among a group of 350 Moonies who, on the orders of Sun Myung Moon, prayed and fasted for 72 hours on the steps of the US Capitol to protest Richard Nixon’s Watergate impeachment in 1974.

“I thought ‘if I wasn’t de-programmed I could have been there, I could have been arrested for this’,” Dr Hassan told The Independent.

“That’s how far gone I was.”
