Feds want 17 years for J6 'eye gouger' who bludgeoned cop with flagpole: report
https://www.rawstory.com/thomas-webster-j6-nypd-prison/The United States Department of Justice is asking for a 17.5-year prison sentence for former New York Police Department Officer Thomas Webster, who was convicted in May of assaulting a police officer during the attack.
"Webster, 56, of Goshen, N.Y., assaulted D.C. police officer Noah Rathbun with an aluminum Marine Corps flagpole, jurors found. The panel of eight women and four men also found Webster guilty of interfering with police in a riot and trespassing, disorderly conduct and violent conduct while carrying a deadly or dangerous weapon on Capitol grounds," The Washington Post reported on May 2. "Webster, who previously served on the protective security detail of former New York mayor Mike Bloomberg, was the first of about 150 defendants charged with assaulting an officer to take his case to a jury and the first to argue self-defense."
Webster's lawyer had complained the victim was "mocking" the rioters and his legal team said he did not deserve to be incarcerated with people who committed "inner-city crimes."

My reading shows prosecutors recommending sentencing and judges ignoring it with much smaller sentencing.
Example: Prosecutors, who called him a domestic terrorist, recommended Wesley Reffitt get 15 years. Because he deserved it for obstructing Congress after leading a charge into the Capitol - while armed with a .40-caliber pistol - and more. And by more I mean threatening his family to the point they sought police protection.
Judge gave him half that.

(15,019 posts)2. Mark you calendar, his sentencing is Friday of next week, Sep 2nd.
This guy is a prime FAFO schadenfreude candidate. He tried to employ a self-defense argument, saying he was defending himself from the DC cop. The jury only took two hours of deliberation time to convict him of 5 felonies and 1 misdemeanor. Afterwards one of the jurors told a reporter that their decision to convict had been "quick and very obvious." Hopefully the judge will go with the sentencing guideline (which is what the prosecutors are asking for, the lower end of the range given in the guidelines) and not depart downwards. There doesn't seem to be any justification for doing so beyond "well, that's a long time."
