Inspector General Report On IRS Targeting Tea Party A Political Sham

The IRS is being accused of selectively targeting Tea Party and conservative groups that were applying for 501(c) tax exempt status. These tax exempt organizations cannot engage in political campaigns. Technically speaking, their purpose is educational and for social welfare.

It is a fact that Tea Party and Conservative groups have been blowing through the limits of what 501(c) nonprofits are allowed to do. As I stated in the article “Liberals Outrage On IRS Tea Party Scrutiny Unjustified & Foolish”, the IRS was justified and doing their jobs in researching these groups that have been actively corrupting the body politic. Unfortunately many Liberals and the President in public articulate otherwise.

The Treasury Inspector General Report For Tax Administration is out. This is the report that President Obama and Whitehouse Chief Spokesman Jay Carney have been alluding to in their respective press conferences. The highlights of the report follow:

To give you an idea of how stupid this whole thing is:

Tea Party Applicant: "Hi! I'm from a group funded by multi billionaires who are trying to shrink government so they won't have to pay any taxes and this group is going to advocate for that. Can we have a tax exempt status while we advocate for never again paying taxes?"

IRS agent: "Hmmmm...."

501 (c) designations. The most common is 501 (c) 3 which may not participate in partisan politics (even though there are several which do on both sides) A 501 (c) 4 (which is what we are talking about) OTOH specifically allowed to participate partisan political activism/lobbying.

Section 501(c) of the United States Internal Revenue Code (26 U.S.C. § 501(c)) provides that 28 types of nonprofit organizations are exempt from some federal income taxes

snip

501(c)(4) organizations are generally civic leagues and other corporations operated exclusively for the promotion of "social welfare", such as civics and civics issues, or local associations of employees with membership limited to a designated company or people in a particular municipality or neighborhood, and with net earnings devoted exclusively to charitable, educational, or recreational purposes.[33] 501(c)(4) organizations may lobby for legislation, and unlike 501(c)(3) organizations they may also participate in political campaigns and elections, as long as its primary activity is the promotion of social welfare.[34] The tax exemption for 501(c)(4) organizations applies to most of their operations, but contributions may be subject to gift tax, and income spent on political activities - generally the advocacy of a particular candidate in an election - is taxable.[35]

So the statement:

These tax exempt organizations cannot engage in political campaigns.

is completely false.

O’Donnell claimed that the real scandal came from the Eisenhower administration in 1959, when the IRS clarified what it meant by “exclusively for the promotion of social welfare.” The IRS changed the word ‘exclusively’ to mean ‘primarily.’

the statement is still false...in 2013.. To make such a blatant elementary mistake/lie in the very first paragraph shut down my interest in anything they have to say in this article.
