Rick Santorum Says Hed Criminally Charge Abortion Providers
SNIP
The 2011 clip, which Buzzfeed dug up, shows Santorum on Meet The Press. In it, he claims that abortion-providing doctors should face legal consequences:
I believe that life begins at conception. And that that life should be guaranteed under the constitution I would advocate that any doctor that performs an abortion should be criminally charged for doing so.

(2,262 posts)Right now, Ricky Santorum is saying that he will 1) first, legally prosecute abortion doctors.
The next step though? 2) Logically, if the embryo is a full human person, then killing one is murder. So that? Santorum is logically committed next, to prosecute doctors as ... murderers.
And then? Though HE DISAVOWS this LOGICAL OUTCOME, I suppose he would also, by his own fatal logic, be bound to 3) prosecute the millions of women that get abortions, as murderesses.
Here's the logic: if embryos are persons, and an abortion kills them, then an abortion kills a person. Therefore, abortion is murder. And since it is murder? It must be prosecuted.
So next? Santorum will apparently be 4) gathering up a special group of para-military Catholic police, to round up millions of women. And 5) take them to prison, and/or execution?
Or maybe 6) Santorum will burn them as witches, or as Protestants?
Anti-abortion extremists like Santorum, and EWTN/RN, and Priests for Life, are very, very dangerous idiots. They don't really know what absurdities and horrors, would logically result, if anyone took them seriously.
There's a long discussion on this and related issues, in the DU "Topics" section, Subsection "Health," sub-sub topic "Pro Choice": http://www.democraticunderground.com/1152257

(150 posts)Don't forget spontaneous abortions(miscarriages), women would be open to criminal prosecution for murder if they had a miscarriage according to the logic of this hate filled idealogue.

(28,979 posts)So women will be charged with murder for using it?

(63,926 posts)All we have to do is go back to the days when abortion was illegal. Those dirty illegal abortions were very efficient killers and maimers of women. They were regular "customers" in Emergency Rooms all across the nation.

(10,602 posts)Remember what Newt said about the law. They had a right to overlook laws they believe are not correct. Sanitorum believes the same thing. He believes he can overlook such legal nuisances.

(3,581 posts)When "The Handmaid's Tale" came out, I said it was about what would happen if Pat Robertson (who was running at the time) was elected. substitute "Rick Santorum" for "Pat Robertson," and it's still true.

(23,623 posts)If you believe abortion is murder, then of course you would hold this view. But abortion is NOT murder, and fetuses are NOT children. Santorum is simply more honest.

(2,262 posts)A view which was justly lampooned by Monty Python, Jimmy Buffett, and the film Legally Blonde.
If every sperm is a human being, and the average sex act wastes 100,000 of them? Then every male on earth is a mass murderer.
Declaring blastocysts to be fully human, puts us onto the slippery slope to absurdity.

(862 posts)The Constitution does not contain the phrase "endowing by their Creator with certain unalienable rights." That is the Declaration of Independence. But knowledge of American history and law is so passe.

(35,392 posts)how about doctors who cannot save patients? How about businesses who, knowingly negligent, put out products which lead to the death of fetuses?

(2,261 posts)that doesn't exist?
Rick, I think you failed freshman criminal law, ... no... you failed junior high school civics.
Unless something changed while the Republicans were in the majority of the House in the last 13 months, AND unless the Supreme Court overturned Roe V Wade while I wasn't looking, abortion is NOT A CRIME in ANY of the 50 states and U.S. Territories!!
Brettongarcia
(2,262 posts)If that is voted in? And then passes constitutional/SCOTUS review? Then abortion would be automatically considered to be ... murder.
Then Santorum could run around jailing millions of women, or burning them at the stake. For being murders, witches, or Protestants.

(2,261 posts)States may not unilaterally rescind rights already granted to any group or individual without due process.
A challenge would immediately invoke a stay of execution on any such law, however enacted, subject to federal judicial review.
Roe v Wade is the law of the land until such time as the Constitution of the US rescinds that through Amendment. It's simple Constitutional law. Any good Constitutional law professor would teach you that....oh wait... he's kind of busy now, he's busy being President.
