Seriously, that they could take this guy to court over behavior that is clearly protected under the First Amendment is outrageous and is likely to have a chilling effect. If NSA and DHS do this enough, there won't be enough pro-bono lawyers around to defend citizens exercising their rights, and free speech could then become quite expensive.
