either by not running in 2020 or losing the 2020 election. He signs a pardon for Pence and the rest of the crew. Pence becomes President on January 19th in time to sign pardon for Trump.

The double jeopardy supreme court case 5-4 decision seals the deal.

I doubt they'd be winning back the House in the process. Either way, the Speaker would only be "president" for a few hours until the new president is sworn into office.

For Pence to pardon Trump, it is not enough for Trump to resign but also for Pence to be properly sworn in.
If this choreographed resignation takes place in the last day of Trump's term that would mean it takes place on Inauguration Day, when everyone will be assembled outside the Capitol for the big ceremony. That leaves no one available to swear Pence in or type up the pardon for Trump, and no witnesses to Trump's claim that he received the pardon in a timely way.

So I figure Trump will do it at least a day before his term would officially end, with a judge to swear Pence in, and a typed pardon waiting for Pence's signature, and TV camera to show Trump receiving the pardon while Pence was clearly still the President. If Pence has any sense, he will insist that Trump give him more than a mere day to be the President - or else no signature on the pardon. If Trump wants that pardon signed, he must give Pence at least a week or maybe a month.

I think it was Joe Scarborough that Pence is the guy who when Russia gets mentioned at all he gets up and leaves the room. Unlike Trump he is smart enough to know what might get him in trouble (or more trouble) and knows how to limit his exposure.
