(18,713 posts)How hard would it have been to ask to see the receipt? The store manager was conspicuously absent.

Erratic and belligerent behavior ...
But let's make this about "he paid for the bike!"

"Did you take dope?" Seriously. They knew in the store that they screwed up.
"The bike is not the issue." "It's for resisting arrest."
They fucked up big time.

(10,536 posts)There was talk of doing that for a while after George Floyd but now no one is saying anything. Qualified Immunity makes it almost impossible to win against the cops.

(1,513 posts)It brought tears to my eyes to see how the man was mistreated by the police. They refused to listen to him.
Some might say just cooperate and it will work out. Bullshit.
This guy wanted to bring his son a bicycle. Instead he spends his day in jail. There is no way his life will ever be the same. They robbed a family of their father. The police should feel shame.
Another note: Thank God for the patience of the camera man. Without his documentation, the officers would cover it up.

(3,131 posts)I agree. If I just bought a bike and was falsely accused of stealing it I would have a real problem staying as calm. And I cant even see imagine the cops showing up and handcuffing me on a trumped up disturbing the peace charge.
The injustice is palpable. I cant imagine having to walk around never knowing when my rights will be abused like this. You can probably tell Im white.
The entitled arrogance of these pos cops. Not one said oh lets see the receipt or lets talk to the checkout clerk. In their minds they have the right to detain, arrest and punish anyone they want for any cause. Not doing any simple investigation should eliminate any claim of probable cause
Why didnt you ask to see the receipt? Because we had probable cause? Bullshit.
Hell probably eventually get off, but he has already been punished. He was arrested, embarrassed, detained and probably spent a day trying to get out of jail. He has the specter of the criminal charges until those get dropped. He might lose his job.
That ability for cops to inflict extrajudicial punishment without personal, professional and financial penalties is a huge oart of the problem.
And if he does win compensation for false arrest or anything else, it wont be this piece of shit cops who pay for it.

(1,513 posts)and a trip to jail. Police get too much military style training. De-escalation should have been a ticket and telling him to go home and enjoy his son's birthday.

(3,131 posts)I cant say I never acted badly in a store when I was young.
It looked more like he was sitting on the bike mostly gliding. People definitely noticed and backed away some but they didnt look very alarmed. Ive definitely glided on the back of shopping carts and never got busted. If I were buying a bike I very well might have sat on it.
Cant say how loud the music was. The cutting line claim is really ambiguous to me. People let me ahead a lot when there is one item.
The thing that strikes me as false is the claim they let him pay so they could banish him. The manager followed him, but I dont see a confrontation (easy to miss though). They had his name from the credit card and could have and should have confirmed id for that. Ive never been banished from a place but it seems odd to allow him to make one more purchase being banned.
In any case they could have and should have gotten out of robocop mode and told him what it was about.

(774 posts)that this man, at this moment, in front of witnesses and on video, has every right and reason to fear for his life. A black man, handcuffed and and in the control of multiple LEOs has a more than possible chance that he will not survive the encounter.

(114,413 posts)This, I think, is one of the main problems we're seeing with these guys, they just can't hear anything that is being said to them because they're so jacked up and acting out of fear that if they don't dominate another person physically, they won't like the consequences.
Cops know how to treat enemy insurgents. They don't know how to treat citizens. We need to understand they're at war and have been for a long time. We are the enemy, all of us.
In an altercation like this, realize when a cop is incapable of hearing you. Don't struggle, they will hurt you. This is very hard to do because it will be an overwhelmingly stressful situation for you but realizing those cops are deaf will help you. Don't talk to them, you're wasting your breath.
Until we get these guys adequate training in how to deal with citizens instead of insurgents, this is going to be how it is..
Stay safe.

(27,436 posts)Stanley Gracius, 37, was confronted by two cops inside the Wyomissing store Monday and arrested while repeatedly asking why he was being taken into custody, and was later tased and hog-tied, according to the Reading Eagle.
I didnt do nothing wrong. Why are you arresting me? Gracius is heard saying on video of the bust posted on Facebook. I paid. Everybody saw that, right? I had a receipt. So why are the cops doing this to me? What did I do wrong? Somebody, please tell me what I did wrong.
A Walmart store manager called police after Gracius was allegedly seen riding the bicycle in the store, playing loud music and shouting profanities, the outlet reported. When police arrived, he was paying for the bike.

Gracius was charged with two counts of aggravated assault, disarming a law enforcement officer, two counts of simple assault, resisting arrest, defiant trespass and disorderly conduct. Gracius was released on $2,500 cash bail.
Adams said he expects some of the charges against Gracius to be withdrawn at his preliminary hearing, but did not say which ones.

(23,128 posts)1. Bike is still inside the store, doesn't qualify as "STOLEN"
2. Appears 1st cop is at check out counter, no ?'s for clerk........WTF?
3. We don't need to see no damn receipt ..............WTF
4. Cops leave evidence at store? Walmart restock it?
5. And to add insult to injury, cops charge him with DISORDERLY CONDUCT because they f**ked up!
WOW, done search for Wyomissing and came across this....
https://heavy.com/news/2020/07/stanley-gaston-gracius/ Guess there's always two sides to every story, this had nothing to do with the bike.

(4,552 posts)This town is about 40 miles from my home in south eastern Pa. This reminds me of the days when racist Rizzo ran Philly.
This town is just west of Reading Pa. The schools in Reading are so bad their graduation rate is 67% but it has increased from 61% over five school years. Their per student spending at 12926.00 is very low. However if you go to any of the affluent school districts in the area you will find they spend 20 grand plus per student.
Reading is 53% white.
This is the face of racism.
Why, Just Why couldn't those cops stop and look at his receipt. He wanted a bike for his boy!
The Jungle 1
(4,552 posts)So apparently the store was trying to ban him from ever coming back. He was riding the bike in store an causing a disruption.
It looks like the police wanted his ID and he refused. I don't think he had broken any law at that point so I don't think he had to provide ID. I guess he could be jammed up on a refusal to vacate when asked. If the store asked.

(15,068 posts)none of the charges had anything to do with theft. Clearly a case of trespass (refusal to leave). In case anyone is interested in what the real story is here --
The Berks County DA was asked to do an independent investigation -- did so, and took the unusual step of releasing a good deal of video of this incident, and a similar incident involving the same man several days prior. Here's the link:
https://www.facebook.com/BerksDA/videos/717134038852842/
here's additional local reporting:

By the time the officers arrived, the man was paying for the bicycle, Adams said. He was then detained by the responding officers.

(15,613 posts)Not a one of them thought to say to the others, "Hey, this is bullshit, this guy didn't do anything wrong." No, all of them had to escalate, escalate, escalate. If there hadn't been a bunch of witness and video being recorded, you know they all would have had a great time beating the shit out of him.
