(2,596 posts)Outnumbered rethugs in the Senate could use surrogates to file lawsuits to sue particular parts of an enacted law and keep it rolling up to the SCOTUS, which would probably declare it unconstitutional. I'm thinking this would more likely than not be case if the Dems decide to add additional justices to the Supreme Court. It would not be unconstitutional, as there is nothing to prohibit it, but the extreme right judges could use some arcane argument to render it so. If the Dems manage to take the senate (and it's going to be hard to do if one is honest here), there is so much long term damage done by rethugs who have held the senate since 2010, that it is going to take more than one election cycle to ameliorate it, and the rethugs are going to more vicious in undoing the efforts than ever before.
