New York amended its double jeopardy law only in late 2019. Bannon’s federal indictment pertained to events in 2018. NY law prohibited state prosecution after a federal prosecution. Since Bannon’s crime predated Oct 16 2019 NY can not now prosecute him. Manafort already won on this same issue. There is no reason to think Bannon will be different.

Justice matters.

I can’t imagine that prosecutors in NY aren’t aware of the issues of double jeopardy and wouldn’t be publicly discussing it if they weren’t pretty sure they could move forward
