I'm not really seeing the 11th as 'slamming' the judge (although that is what the guest said, and that may be the 'take away' in the better versed legal circles). But, I suspect the court will overrule, on merit (as per usual) - without any 'slamming' of the lower bench for rationale or motivation.

Did like that the guest narrowed down on the documents case with straightforward fact. "We did ask .. We did have court approval and right to recovery .. You did lie, and attempt to conceal documents clearly covered .. We did find these items in your desk, with your passports .. "

That's the type of nut in a vise stuff that makes defendants, and defense counsel, squirm.
