U.S. Attorney appeals order to release Uzbek terror suspect from custody in Colorado before trial
The U.S. Attorney’s Office has appealed a judge’s order to release an Uzbek refugee before his trial on charges that he provided material support to the Islamic Jihad Union.
The appeal to the U.S. 10th Circuit Court of Appeals in Denver was made in hopes of halting the release this week of Jamshid Muhtorov, who was arrested by FBI agents in January of 2012 and been locked up for 5½ years without a trial.
Assistant U.S. Attorney Gregory Holloway has said there are no conditions or combination of conditions that would ensure public safety if Muhtorov is released pending his trial, which has been delayed until March of 2018.
U.S. District Court Senior Judge John Kane ordered Muhtorov’s release on Friday, citing the fact that he is considered innocent until proved guilty and has a wife and three children living in the Denver area.
