Minnesota lawmaker doesn’t live in district, should be removed from ballot, judge rules

A state lawmaker may be kicked off the ballot after a judge found he doesn’t live in his legislative district.

The final decision on whether state Rep. Bob Barrett (R) should be removed from the ballot will be made by the Minnesota Supreme Court, which will hear the case on Sept. 6.

But after reviewing evidence from Barrett and anti-Barrett activists, Judge George Stephenson ruled Friday that “clear and convincing evidence” suggests Barrett “did not reside in Legislative District 32B.”

“The evidence supports removing Candidate Barrett’s name from the ballot,” Stephenson wrote in his opinion.

About time some one checks on these Resident Requirements. That's going to leave a mark. How many more are there out there?

(though I believe it's too late to get her off the ballot) because she is military and prevented from running by the Hatch Act. You'd think they'd check these things out before endorsing someone.

manager because of the Hatch Act. Had to pack it in with two months to go and only down 3 points. Any word on Legislation that passed with a one vote margin,that would be real interesting for the Courts. Seems we have seen this type of thing before,remember there were issues after the redistricting in 2000.
