Federal judge allows Elon Musk lawsuit to continue

New Mexico and other states filed the lawsuit

A federal judge is allowing a lawsuit to proceed, brought by New Mexico and 13 other states -- that alleges Elon Musk was not "properly" appointed to his high-level position, and has been illegally making sweeping changes to the federal government since.

Lawyers for the Trump administration had asked for the case to be thrown out. "This was the first challenge that the Trump administration made to this lawsuit, and they lost," KOAT Legal Expert John Day said.

Attorney General Raul Torrez says he spurred the litigation, with other Attorneys General, including from Arizona and Michigan.
"President Trump... empowered an unelected billionaire to go into various federal agencies and engage in some pretty chaotic and disruptive activity," Torrez said. He added that this is one of the first times his office has sued over a claim involving the U.S. Constitution and a president's authority.
