Peekskill birth-control case: Dad's suit moves to federal court

Swapna Venugopal Ramaswamy

PEEKSKILL – A state lawsuit brought by a teacher against the Peekskill school district for taking his then-16-year-old daughter off campus to get birth control pills in 2011 has been moved to federal court.

The district filed a motion to remove the case to federal court, saying it deals with matters involving the First and 14th Amendments.

The Aug. 22 federal lawsuit claims the district retaliated against Woodside Elementary School teacher Anthony Jackson for filing the first lawsuit by "illegally" publicizing details of a disciplinary case against him in violation of state Education Law.
