Bloomberg sues City Council to overturn law targeting stop-and-frisk profiling
By Barbara Ross / NEW YORK DAILY NEWS
Mayor Bloomberg kept his promise: He filed a lawsuit against City Council to overturn one of the two laws passed last month to curtail the NYPD's controversial stop-and-frisk program.
In papers filed Tuesday afternoon in Manhattan Supreme Court, the mayor's Law Department says a measure that would make it easier for those stopped to sue for profiling "exceeds the bounds of permissible legislation by the Council."
The law allows plaintiffs to sue the NYPD for profiling in state court and expands the definition of profiling to include categories such as age, gender, sexual orientation and housing status.
Bloomberg's lawsuit says the state criminal procedure law already puts "limits and obligations" on cops, and only the state legislature can change it.
